What is an investment visa?

An investment visa is a visa issued to foreigners who want to participate in investment activities in Vietnam. Investors can be individuals or representatives of foreign organizations investing in Vietnam. This visa helps them legalize their right to enter, reside and invest in Vietnam. Investment visas can be classified based on the level of capital contribution or the investment industry that the investor chooses.

Types of investment visas according to current regulations

Investment visas in Vietnam are currently divided into 4 main types, depending on the value of the investor’s capital contribution:

• DT 1: Issued to foreign investors or representatives of foreign organizations with a capital contribution of 100 billion VND or more or investing in investment incentive industries or investment incentive areas according to the Government’s decision.
• DT 2: Granted to investors with capital contribution from 50 billion VND to less than 100 billion VND, or investing in industries that encourage investment and development as prescribed by the Government.
• DT 3: Issued to investors with capital contribution from 3 billion VND to less than 50 billion VND.
• DT 4: Issued to investors with a capital contribution of less than 3 billion VND.

Duration of visa issued to foreign investors in Vietnam

The duration of the investment visa will depend on the type of visa the investor applies for. Specifically as follows:

• Visa DT1, DT2: Valid for no more than 5 years.
• DT3 Visa: Valid for no more than 3 years.
• Visa DT4: Valid for no more than 1 year.

In addition, if there are international treaties to which Vietnam is a member, the visa duration may be adjusted according to those international commitments.

CSPL: Article 9 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014, amended and supplemented in 2019.

Cases of unilateral visa exemption for foreign investors

Article 13, Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014, stipulates unilateral visa exemption for foreign citizens when the following conditions are met:

• Has diplomatic relations with Vietnam.
• In accordance with Vietnam’s socio-economic development and foreign policy in each period.
• Do not harm Vietnam’s national defense, security and social order.

In this case, the visa-free visa can be valid for no more than 5 years and can be considered for extension.
