According to Clause 1, Article 2 of the Law on Prevention and Control of Harmful Effects of Alcoholic Beverages 2019, alcohol business means traders carrying out activities of producing, importing, distributing, wholesaling and retailing alcohol; alcohol sales for on-site consumption.

Conditions for selling wine with an alcohol content of 5.5 degrees or more

Wine with an alcohol content of 5.5 degrees or more is considered strong alcohol and the sale of this type of alcohol is strictly controlled by law. Below are the conditions for trading wine with an alcohol content of 5.5 degrees or more as prescribed in Decree 105/2017/ND-CP, amended by Decree 17/2020/ND-CP:

Conditions for industrial wine production

To produce industrial wine, businesses need to meet the following conditions:

  • Is an enterprise established according to the provisions of law.
  • There are machinery, equipment, and technological processes for wine production that meet the expected scale of production.

Conditions for producing handcrafted wine to sell to establishments with a Liquor Production License for reprocessing

In case of manual wine production and sale to establishments with a wine production license for reprocessing, the following conditions must be met:

Have a sales contract with an enterprise that has a license to produce industrial alcohol.

In case of not selling alcohol to an enterprise with a License to produce industrial alcohol, organizations and individuals producing alcohol manually must carry out procedures for granting a License to produce alcohol manually for business purposes according to regulations.

To distribute alcohol, businesses need to meet the following conditions:

  • Is an enterprise established according to the provisions of law.
  • Have a wine distribution system in 02 provinces and centrally run cities or more; In each province or centrally run city, there must be at least 01 alcohol wholesaler. In case an enterprise establishes a branch or business location outside the head office to sell alcohol, confirmation from the alcohol wholesaler is not required.
  • There is a written introduction or principle contract from a wine producer, another wine distributor, or an overseas wine supplier.

Conditions for wholesaling alcohol

Conditions for being a wine wholesaler include:

  • Is an enterprise established according to the provisions of law.
  • Have a wine wholesale system in the province or centrally run city where the enterprise is headquartered with at least 01 wine retailers. In case an enterprise establishes a branch or business location outside the head office to sell alcohol, confirmation from the alcohol retailer is not required.
  • There is a written introduction or principle contract of a wine producer, wine distributor or other wine wholesaler.

Conditions for retail sale of alcohol

Enterprises, cooperatives, cooperative unions or business households that want to retail alcohol need to meet the following conditions:

  • Being an enterprise, cooperative, cooperative union or business household established in accordance with the law.
  • Have the right to legally use a fixed business location with a clear address.
  • There is a written introduction or principle contract of a wine producer, wine distributor or wine wholesaler.

Conditions for selling alcohol for on-site consumption

For on-site alcohol sales, businesses, cooperatives, cooperative unions or business households need to meet the following conditions:

  • Being an enterprise, cooperative, cooperative union or business household established in accordance with the law.
  • Have the right to legally use a fixed business location, clear address, and register to sell alcohol for on-site consumption with the Economic Department or the District Economic and Infrastructure Department where the trader has their business.
  • Alcohol for on-premise consumption must be supplied by a trader holding a License to manufacture, distribute, wholesale or retail alcohol.
  • In case a trader produces their own wine for on-site consumption, they must have a License for industrial wine production or a License for manual wine production for business purposes according to regulations.

Wine with an alcohol content of less than 5.5 degrees is considered light wine and the sale of this type of wine has its own regulations. To produce wine with an alcohol content of less than 5.5 degrees, the following conditions must be met:

  • Being an enterprise, cooperative, cooperative union or business household established in accordance with the law.

  • Register with the Economic Department or the Economic and Infrastructure Department of the district People’s Committee where the trader has its production facility. In case there is a change to the registered content, additional registration must be made.

To import wine with an alcohol content of less than 5.5 degrees, customers need to meet the following conditions:

  • Being an enterprise, cooperative, cooperative union or business household established in accordance with the law.

  • Wine can only be imported into Vietnam through international border gates.
