Procedure for Construction Material Conformity Declaration

Dossier Components

Based on Subsection 3.2.2, Section 3.2, Part 3 of QCVN 16:2023/BXD and Clause 1, Article 14 of Circular 28/2012/TT-BKHCN (amended by Clause 4, Article 1 of Circular 02/2017/TT-BKHCN and Clause 4, Article 19 of Circular 06/2020/TT-BKHCN).

First, for a declaration based on the self-assessment results of the organization or individual, the dossier includes:

  • A declaration of conformity (Form No. 2 CBHC/HQ in Appendix III, Circular No. 28/2012/TT-BKHCN).
  • A self-assessment report containing:
    • Name, address, phone, and fax of the organization/individual.
    • Name of the product/goods, manufacturer.
    • Number of the national technical regulation.
    • Test results consistent with the national technical regulation from a qualified testing organization for Group 2 products.
    • A conclusion that the product/goods conform to the national technical regulation.
    • A commitment that the product/goods quality conforms to the national technical regulation and applied standards, and a statement of full legal responsibility for the product quality and self-assessment results.

Second, for a declaration based on the certification results of a registered or designated certification organization (third party), the dossier includes:

  • A declaration of conformity (Form 2. CBHC/HQ in Appendix III, Circular No. 28/2012/TT-BKHCN).
  • A certified true copy of the Certificate of Conformity, including the conformity mark model, issued by the registered or designated certification organization.

Implementation Process

The procedure is specified in Subsection 1.1, Section II, Part A, Part II of the Administrative Procedures issued with Decision No. 1290/QD-BXD. The steps are:

  • Step 1: The organization or individual submits the declaration dossier to the provincial Department of Construction (Sở Xây dựng) where the business is registered.
  • Step 2: The Department of Construction reviews the dossier for validity.
  • Step 3: If the dossier is valid, the Department of Construction issues a Notice of Receipt (Form 3. TBTNHS, Circular No. 28/2012/TT-BKHCN). If the dossier is invalid, the Department of Construction issues a written notice to the organization/individual explaining the reasons for non-receipt.
