According to the provisions of Clause 1, Article 23 of Decree 91/2020/ND-CP, the identifier is defined as follows:

The sender’s brand name used in advertising activities by text message or phone call (hereinafter referred to as brand name) includes no more than 11 consecutive characters using Latin letters and numbers ( from 0 to 9) or characters (-), (_), (.), space; does not distinguish between uppercase and lowercase letters; zero is a set of numbers only and is used to display or identify information about the sending source.

Regulations on use of identifiers

The use of identifiers is regulated in Article 23 of Decree 91/2020/ND-CP. Below are the regulations on using identifiers as follows:

  • Every organization and individual has the right to register and use an unlimited number of identifiers for advertising purposes by text messages and phone calls.
  • The identification name issued to organizations and individuals is unique in the National Identification Name System issued by the Ministry of Information and Communications (Department of Information Security) and has a validity period of 03 years from the date of issue.
  • The registration and use of identifiers is carried out according to the following principles: Equality, non-discrimination; Pre-register to get first use; Avoid causing misunderstanding or distortion due to polysyllables, multiple meanings or lack of diacritics in Vietnamese.
  • Organizations and individuals registering to use identifiers must be responsible before the law for the purpose of use, the accuracy of registration information and the authenticity of documents and information in the registration dossier.
  • Organizations and individuals are not allowed to use identifiers that are not granted by the Ministry of Information and Communications or have been granted by the Ministry of Information and Communications to other organizations and individuals, except in cases where the organization or individual with the right to use the identifier permits it. They must not infringe upon the legitimate rights and interests of the organization or individual that has registered the identifier.
  • Organizations and individuals may not use the identifier after it is revoked.
  • Organizations and individuals who are granted identification names must pay fees according to the provisions of law on fees and charges and pay costs for maintaining the activities of identification names.

Order and procedures for registering and granting identification names

To be granted a legal identification name, customers need to prepare documents and follow the prescribed order and procedures.

The registration dossier for granting an identification name includes:

  1. For organizations:
  • A certified copy of the organization’s establishment decision or business registration certificate. In case an organization or enterprise registers multiple identification names at the same time, only provide 01 business registration certificate or 01 authenticated establishment decision of the organization;
  • Identification name registration declaration according to Form No. 01 Appendix issued with Decree 91/2020/ND-CP;
  • Other documents related to intellectual property rights and trademark registration (if any).
  1. For individuals:
  • Certified copy of identity card or citizen identification card or passport;
  • Identification name registration declaration according to Form No. 01 Appendix issued with Decree Decree 91/2020/ND-CP;
  • Other documents related to intellectual property rights and trademark registration (if any).

Step 1: Submit application. Submit your application through one of the following options:

  • Submit paper documents via postal service to the Ministry of Information and Communications (Department of Information Security).
  • Submit your application online at the National Identification Name Management System.

Step 2: Confirm receipt of application

Immediately after receiving the application, the Ministry of Information and Communications (Information Security Department) is responsible for confirming receipt of the application by sending an email or text message to the organization or individual submitting the application, specifically stating the date and time the application was received.

Step 3: Review the validity of the application and issue an identification name

  • Within 01 working day from receipt of the dossier, the Ministry of Information and Communications (Department of Information Security) reviews the validity of the dossier.
  • Grant identification names to organizations and individuals and notify organizations and individuals via email or text message. After organizations and individuals pay the fee, they are responsible for sending the certificate of identification name according to Form No. 02 Appendix issued with Decree 91/2020/ND-CP via email;
  • Do not issue identification names to organizations or individuals in cases where the dossier is incomplete or needs clarification. The organization or individual will supplement, decode, complete the dossier and resubmit the dossier and notify the reason. to organizations and individuals via email or text message.
