Below are some frequently asked questions regarding mandatory documentation for livestream sales that you may find helpful:
The 2025 E-commerce Law does not mandate notarized copies, but requires the provision of complete supporting documents. In practice, electronic transactions, photocopies (soft copies) are valid proof if agreed upon by the parties and can be compared with the original when necessary. However, to ensure the highest legal validity in case of disputes, the parties should store electronically authenticated copies.
(Legal basis: Clause 1, Article 23 of the 2025 E-commerce Law.)
No. At the time of the livestream, the seller must meet the business investment requirements. If the license has expired, the seller no longer has the legal capacity to conduct business in that industry, therefore the livestreamer must refuse to cooperate as per regulations.
(Legal basis: Point a, Clause 1, Article 23 and Clause 3, Article 24 of the Law on E-commerce 2025.)
For agricultural products, sellers need to provide documents proving origin (such as confirmation from cooperatives, local authorities, or planting area codes) and documents proving food safety and quality (such as VietGAP, GlobalGAP certificates, or commitments to safe production) depending on the scale of production.
(Legal basis: Point b, Clause 1, Article 23 of the 2025 Law on E-commerce.)
The law stipulates that livestreamers must request full documentation. However, livestreamers do not have the authority to verify the authenticity of the documents. Their responsibility is to check the completeness and formal validity of the documents (validity, correct name, correct product). They are only held jointly liable if they know the documents are fake but still livestream.
(Legal basis: Clause 3, Article 24 of the 2025 E-commerce Law.)
No. Goods circulating in Vietnam are required to have Vietnamese labels and documents proving their legal import origin (customs declaration). If the seller cannot provide these documents, the goods are considered smuggled or of unknown origin, and the livestreamer must refuse to sell them.
(Legal basis: Point b, Clause 1, Article 23 of the 2025 Law on E-commerce.)
The livestream content must conform to the approved advertising content. This means that core information regarding uses, features, and indications must be accurate. The livestreamer can use fluent spoken language but must not add any uses not included in the approved text.
(Legal basis: Clause 2, Article 23 and Clause 5, Article 24 of the Law on E-commerce 2025.)
Sellers are responsible for providing documentation to those live-streaming their sales. For affiliate marketers, while there isn’t a mandatory requirement to provide documentation directly like with live-streaming, they must still ensure that the information they share is accurate and does not violate advertising laws.
(Legal basis: Clause 1, Article 23 and Clause 14, Article 3 of the Law on E-commerce 2025.)
Compliance with regulations regarding documentation for livestreaming sales is mandatory to minimize risks for both sellers and livestreamers. The E-commerce Law 2025 has established a strict legal framework to protect consumers and increase market transparency.
