Authority to issue license to organize international exhibitions

The authority to grant license to organize international exhibitions is specified in Article 11 of Decree 23/2019/ND-CP. Accordingly, there are two authorities with licensing authority, depending on the scale and nature of the exhibition:

The Ministry of Culture, Sports and Tourism grants exhibition organization licenses to:

  • Exhibitions are brought abroad by central organizations.
  • Exhibition organized by international organizations and foreign organizations in Vietnam.
  • The exhibition is jointly bought abroad by organizations from 02 provinces and cities or more.

The Department of Culture, Sports and Tourism or the Department of Culture and Sports issues exhibition organization licenses to:

  • Exhibitions are brought abroad by local organizations and individuals.
  • Exhibition organized locally by foreign individuals.
  • Identifying the correct licensing authority ensures that the application is submitted to the correct address and the licensing process goes smoothly.

Procedures for applying for a license to organize international exhibitions

Procedures for applying for a license to organize international exhibitions are prescribed in Decree 23/2019/ND-CP. Basically, the procedure includes the following steps:

An application for a license to organize international exhibition includes the following documents:

  • Application for an exhibition organization license (according to Form No. 01 in the Appendix attached to Decree 23/2019/ND-CP).
  • List of works, artifacts, documents (clearly stating the name of the author, owner; name, quantity, material, size of the work or artifact, documents; accompanying notes).
  • Photos of each work, artifact, document and display (size 10×15 cm) printed on paper or recorded on digital storage media.
  • Document of agreement or invitation, notice, contract of the foreign party on the organization of the exhibition (for exhibitions brought abroad by central organizations). Document of agreement or contract to rent or borrow exhibition location (for exhibitions organized by international organizations or foreign organizations in Vietnam).
  • Copy of one of the following documents: ID card or citizen identification card of the exhibition organizer (for exhibitions organized by Vietnamese individuals); Passport (for exhibitions organized by foreigners or Vietnamese residing abroad).
  • Plan to ensure conditions of social order and safety, environmental sanitation and fire and explosion prevention (for exhibitions organized by international organizations and foreign organizations in Vietnam).

Documents in foreign languages ​​must be translated into Vietnamese and authenticated according to the provisions of law.

Order and procedures

The order and procedures for applying for a license to organize international exhibitions are carried out according to the following steps:

Step 1: Submit application:

  • Organizations and individuals submit 01 set of documents to the competent licensing agency.
  • Can be submitted in person, by mail or through online public services.

Note:

  • In case of sending documents directly, bring the original for comparison.
  • In case of sending documents by post, send a valid and certified copy.
  • In case of submitting documents via online public services, send a photocopy of the original.

Step 2: Document appraisal:

The competent authority establishes an exhibition content appraisal council to evaluate the dossier.

The Council has an odd number of members, from 03 members or more, including representatives of relevant agencies, experts in related fields, in which the Chairman of the Council is the representative of the authority competent to issue Licenses or receive Notifications.

Step 3: Document processing:

  • In case the application is not eligible for issuance of a License because it contains content that violates regulations, within no more than 07 working days from the date of receiving the valid application, the competent agency is responsible for responding to the organization or individual in writing, clearly stating the reason.
  • In case the dossier is incomplete, invalid or needs to adjust the exhibition content, the competent authority is responsible for sending a written request to the organization or individual to supplement the dossier or adjust the exhibition content. Time for organizations and individuals to supplement documents; Adjust the exhibition content no later than 05 working days from the date of receiving the written request from the competent authority.
  • The time limit for returning the second results to organizations and individuals is no more than 03 working days from the date the competent authority receives additional documents or written confirmation agreeing to adjust the exhibition content.

Step 4: Licensing:

The competent authority shall issue the license within no more than 07 working days from the date of receipt of valid documents.
