Article 33 of Decree 357/2025/NĐ-CP (effective from March 1, 2026) specifies the exploitation of information and data on housing and the real estate market as follows:
The Ministry of Construction is entitled to exploit all information and data integrated, connected, shared, provided, and updated on the information system and database of housing and the real estate market. Data exploitation activities related to personal data and master data must comply with the law on personal data protection, national data architecture frameworks, and national data management/governance frameworks. Data access is performed through a decentralization and monitoring mechanism with clearly described purposes; sensitive data must be anonymized or granted special access rights, including:
Data shared and connected from national databases on population, land, construction, planning, and specialized databases on investment, finance, tax, banking, and notarization of ministries and branches as prescribed in Article 28 of Decree 357/2025/NĐ-CP.
Information and data from Provincial People’s Committees as prescribed in Article 29 of Decree 357/2025/NĐ-CP.
Ministries and branches specified in Article 28 of Decree 357/2025/NĐ-CP are entitled to exploit information and data to serve their respective state management tasks. Exploiting housing and real estate market data outside their management scope requires approval from the management agency of the housing and real estate market information system.
Provincial People’s Committees are entitled to exploit all housing and real estate market data within their local jurisdiction.
Organizations and individuals wishing to exploit specialized and detailed information/data on housing and the real estate market as prescribed in Appendix VI attached to Decree 357/2025/NĐ-CP shall send a request form (using the template in Appendix III) to the Ministry of Construction via: online submission on the National Public Service Portal, direct submission at the one-stop-shop of the Ministry of Construction, postal services, or the administrative procedure handling system of the Ministry of Construction.
Forms of exploiting and using information on housing and the real estate market include:
Direct exploitation and use through the Web Portal of the housing and real estate market information system.
Exploitation and use through online data connection and sharing between information systems.
Exploitation and use by sending written requests to competent authorities.
Within 07 days from the receipt of a registration for access/use rights, the Ministry of Construction shall consider granting access, exploitation, and use rights electronically or via the Notification template in Appendix IV. In case of refusal, a response stating the reason must be provided using the template in Appendix V.
State secrets, information related to the identity data of other citizens, and information related to the business activities of enterprises shall not be exploited except for serving the activities of state management agencies.
Foreign organizations may only access and exploit information/data through secure APIs or anonymous copies; they are not allowed to copy original data containing identity information.
Sharing or transferring information/data cross-border must comply with the law on data before provision.
Disclosing information about housing and the real estate market
The disclosure of information is an obligation of the management agency to ensure transparency in the real estate market, as stipulated in Article 35 of Decree 357/2025/ND-CP, specifically as follows:
The Ministry of Construction publishes aggregated information on housing and the real estate market nationwide on the housing and real estate market information system at the website https://batdongsan.xaydung.gov.vn, on a quarterly basis: Before the 15th day of the first month of the quarter following the publication quarter.
Provincial People’s Committees shall publish aggregated information on housing and the real estate market within their jurisdiction on the portal of the housing and real estate market information system and on the local government’s managed website on a quarterly basis: Before the 15th day of the first month of the quarter following the publication quarter.
