Subjects are required to have a current food hygiene and safety certificate

According to the provisions of Clause 1, Article 11 of Decree 15/2018/ND-CP, food production and business establishments must have a food safety certificate, except for the following cases:

  • Initial production was small;
  • Food production and trading without a fixed location;
  • Small preliminary processing;
  • Small food business;
  • Trading in pre-packaged foods;
  • Producing and trading in tools and materials for packaging and storing food;
  • Restaurant in hotel;
  • The collective kitchen does not have a registered food business;
  • Street food business;
  • The facility has been granted one of the following Certificates: Good Manufacturing Practices (GMP), Hazard Analysis and Critical Control Points (HACCP), Food Safety Management System ISO 22000, Standard International Food Safety System (IFS), Global Food Safety Standards (BRC), Food Safety System Certification (FSSC 22000) or valid equivalent.

Necessary documents to apply for a food hygiene and safety certificate

According to Article 36 of the Law on Food Safety 2010, regulations on dossiers, order and procedures for granting Certificate of facility meeting food safety conditions are as follows:

  • Application for issuance of Certificate of establishment meeting food safety conditions;
  • Copy of Business Registration Certificate;
  • Explanation of facilities, equipment and tools to ensure food hygiene and safety conditions according to regulations of competent state management agencies;
  • Certificate of good health of the facility owner and person directly producing and trading food issued by a district-level medical facility or higher;
  • Certificate of training in food safety and hygiene of the facility owner and of the person directly producing and trading food according to regulations of the Minister of Industry Management.

Depending on the actual food product/service of the business, the unit that issues food safety certificates is also different. Currently, the competent authorities in issuing this license include:

  • Ministry of Health: for food processing facilities and food service businesses; production of additives, flavorings, food processing aids, bottled drinking water, natural mineral water, food ice (instant ice and ice used for food processing), functional foods, micronutrients added to food,… (Appendix II issued with Decree 15/2018/ND-CP);
  • Ministry of Agriculture and Rural Development: for establishments and enterprises producing and trading in agriculture, forestry, fisheries,… (Appendix III issued with Decree 15/2018/ND-CP);
  • Ministry of Industry and Trade: for establishments and enterprises producing and trading alcohol, beer, soft drinks, confectionery,… (Appendix IV issued with Decree 15/2018/ND-CP).

Appraisal process for production and business establishments

Within 15 days from the date of receipt of complete and valid documents, the competent state agency shall conduct an actual inspection of food safety conditions at food production and business establishments.

  • If eligible, a Certificate of establishment meeting food safety conditions must be issued;
  • In case of refusal, you must respond in writing and clearly state the reason.

Certificate issuance time and fees

The time to receive a food hygiene and safety certificate is 15 days from the date the competent authority receives all valid documents.

Pursuant to the Fee Schedule for Food Safety Work issued together with Circular 76/2021/TT-BTC issued by the Ministry of Finance on August 5, 2021, appraisal fees for issuance of certificates of eligibility for hygiene safety Food is defined as follows:

Appraisal of food business establishments: 1.000.000 VND/time/establishment.

Appraisal of food service establishments:

  • Serving less than 20 meals: 700.000 VND/time/establishment;
  • Serving 20 meals or more: 1.000.000 VND/time/establishment.

Appraisal of food production facilities (except health food production facilities)

  • For small-scale production establishments that are granted a certificate of establishment meeting food safety conditions: 500.000 VND/time/facility;
  • For other production establishments (including both production and business establishments) that are granted a certificate of establishment meeting food safety conditions: 2.500.000 VND/time/facility.

Appraisal of health protection food production facilities according to good manufacturing practice (GMP) guidelines: 22.500.000 VND/time/facility.
