How is the use of identifiers regulated?
According to the provisions of Clause 1, Article 23, Decree 91/2020/ND-CP, regulations on using identifiers are determined in detail with the following principles:
The brand name used in advertising activities via text messages or phone calls (hereinafter referred to as brand name) must have a maximum of 11 characters, including Latin letters and numbers (0-9) or characters (-), (_), (.), space; does not distinguish between uppercase and lowercase letters. This name cannot be a string of characters containing only numbers and must clearly indicate the sending source;
All organizations and individuals have the right to register and use an unlimited number of identifiers for advertising purposes via text messages and phone calls;
The identification name issued to organizations and individuals is unique in the national identification name system managed by the Ministry of Information and Communications (Department of Information Security) and has a validity period of 03 years from the date of issuance;
The registration and use of identifiers must comply with the following principles: equality, non-discrimination, priority for registration and first use, and avoidance of confusion due to polysemy, polyphony or non-use of accents in Vietnamese;
Organizations and individuals registering identification names are responsible for the purpose of use, the accuracy of registration information and the authenticity of documents and information in the records;
It is not allowed to use an identifier that is not issued by the Ministry of Information and Communications (Information Security Department) or has been issued to another organization or individual, unless permitted by the organization or individual that owns that identifier. It is forbidden to infringe upon the legitimate rights of those who have registered;
An identifier may not be used after it has been revoked;
Organizations and individuals who are granted identification names must pay fees according to the provisions of law on fees and charges, along with the costs of maintaining the operation of the identification name according to regulations of the Ministry of Information and Communications.
Procedures for applying for a certificate of identification name
Documents need to be prepared
According to the provisions of Article 24, Decree No. 91/2020/ND-CP, the components of documents for implementing business identification name registration procedures are specifically specified as follows:
Case 1: For organizations
Certified copy of the organization’s establishment decision or business registration certificate;
Identification name registration declaration according to Model number 01Appendix issued together with Decree No. 91/2020/ND-CP;
Other documents related to intellectual property rights and trademark registration (if any).
Case 2: For individuals
Certified copy of identity card or citizen identification card or passport;
Identification name registration declaration according toModel number 01Appendix issued together with Decree No. 91/2020/ND-CP;
Other documents related to intellectual property rights and trademark registration (if any).
Regulations on documents that need to be prepared
Implementation process
According to the provisions of Article 25, Article 26, Decree No. 91/2020/ND-CP, the process of registering business identification is carried out through the following steps:
Step 1: Submit application
Submit paper documents via postal service to the Ministry of Information and Communications (Department of Information Security);
Step 2: Receive confirmation notice from the Information Security Department
Immediately after receiving the application, the Ministry of Information and Communications (Information Security Department) is responsible for confirming receipt of the application by sending an email or text message to the organization or individual submitting the application, specifically stating the date and time the application was received.
Step 3: Appraise documents and issue certificates
Within 01 working day from receipt of the dossier, the Ministry of Information and Communications (Department of Information Security) reviews the validity of the dossier and decides on one of the following cases:
Grant identification names to organizations and individuals and notify organizations and individuals via email or text message;
In case an identification name is not granted to an organization or individual, if the dossier is incomplete or needs clarification, the organization or individual will supplement, decode, complete the dossier and resubmit the dossier according to regulations.
