What is fire protection acceptance?

Fire protection acceptance is the process of checking and evaluating the results of construction and installation of the project’s fire protection system compared to the approved design. The Fire Police Department will conduct document inspection, actual testing and issue written approval if the results are satisfactory.

Content of fire protection acceptance

According to the provisions of Clause 3, Article 15 of Decree 136/2020/ND-CP, the content of fire protection acceptance includes:

  • Check the content and legality of acceptance documents on fire prevention and fighting prepared by investors and motor vehicle owners;
  • Check the compatibility between the acceptance results of the investor and vehicle owner with the design previously approved by the Fire Prevention and Fighting Police agency;
  • Organize inspection and testing of actual operating probability of fire prevention and fighting vehicles and equipment and systems related to fire prevention and fighting of construction works and motor vehicles to compare with test results of investors and vehicle owners.

Fire protection acceptance is carried out as follows:

Acceptance records

Pursuant to Clause 2, Article 15 of Decree 136/2020/ND-CP, fire protection acceptance documents include:

  • A copy of the Certificate or document approving the fire prevention and fighting design, enclosed with a dossier stamped with the approval stamp of the Fire Prevention and Fighting Police agency;
  • Copy of Fire Prevention and Fighting Equipment Inspection Certificate;
  • Minutes of testing, partial acceptance and overall acceptance of the fire prevention and fighting system;
  • As-built drawings of the fire prevention and fighting system and items related to fire prevention and fighting are consistent with the approved design documents;
  • Documents and procedures guiding the operation and maintenance of fire prevention and fighting equipment and systems and systems related to fire prevention and fighting of works and motor vehicles;
  • Acceptance documents for completed items and systems related to fire prevention and fighting;
  • Copy of Certificate of eligibility to conduct business in fire prevention and fighting services of the supervision consulting unit (if any), the unit that constructs and installs the fire prevention and fighting system.

Documents included in the file must be certified by the investor, vehicle owner, supervision consultant, and construction unit. If documents are in a foreign language, they must be translated into Vietnamese.

Acceptance process

According to the provisions of Clause 4, Article 15 of Decree 136/2020/ND-CP amended and supplemented by Clause 1, Article 7 of Decree 50/2024/ND-CP, the fire protection acceptance process includes the following steps:

Step 1: Submit application

Agencies, organizations and individuals submit 01 set of documents above, accompanied by a report from the investor and vehicle owner on the status of construction results, inspection, verification, testing and acceptance of fire prevention and fighting systems, equipment and solutions and a written request to check and accept the fire prevention and fighting results (Form No. PC11) to the Police agency that has previously appraised and approved in one of the following forms:

  • Directly at the One-Stop Department of the competent authority;
  • Online at the Public Service Portal;
  • Through the public postal service.

Application submission time: At least 10 working days in advance for important national projects and works, group A projects and works or at least 07 working days in advance for remaining projects and motor vehicles with special requirements to ensure fire safety compared to the date the investor or vehicle owner requests to organize the acceptance test.

Step 2: Receive documents

The officer receiving the dossier checks the composition and validity of the dossier.

  • In case the dossier is complete and valid: Receive and record information in the Receipt Form for handling administrative procedures on fire prevention and fighting.
  • In case the documents are missing or invalid: Instructions for completing the documents and recording information in the Document Supplement Instruction Form.

Step 3: Notify the results of application processing

  • In case of submitting the application directly at the One-Stop Department, the officer receiving the application must directly hand over 01 copy of the Receipt Form for settlement of administrative procedures on fire prevention and fighting or the Instruction Form for supplementing the dossier requesting settlement of administrative procedures on fire prevention and fighting to the person submitting the application and keep 01 copy;
  • In case of submitting the application through the Public Service Portal, the information system handling administrative procedures of the competent authority, the receiving officer will send a notification via email or phone message about the receipt or request for guidance and supplementation of the application to the agency, organization or individual that submitted the application;
  • In case of submitting the application via public postal service, through hiring a service from a business or individual or through authorization according to the provisions of law, the officer receiving the application will send 01 copy of the Receipt Form for settlement of administrative procedures on fire prevention and fighting or the Instruction Form for supplementing the dossier requesting settlement of administrative procedures on fire prevention and fighting to the address of the agency, organization or individual that previously submitted the application and save 01 copy.
  • Within 07 working days from the date of approval of the acceptance inspection record, the Fire Prevention and Fighting Police agency is responsible for reviewing and issuing a document approving the acceptance results on fire prevention and fighting and returning the previously received acceptance documents to the investor and vehicle owner. In case of disapproval of the acceptance results, there must be a written response, clearly stating the reason.
