Procedures for reporting results of promotion implementation

Reporting the results of promotional activities helps management agencies control promotional activities and ensure the rights of consumers. Below are the steps and legal requirements for this procedure.

Documents need to be prepared

Documents reporting promotional results include:

  • Report on results of promotion implementation: According to form No. 07, Appendix issued with Decree No. 81/2018/ND-CP;
  • Authorization document for the person submitting the application if this person is not the legal representative of the enterprise or business household.

Execution order

Procedures for reporting the results of promotion implementation are specified in Clause 2, Article 21 of Decree 81/2018/ND-CP amended by Point b, Clause 7, Article 1 of Decree 128/2024/ND-CP taking effect from December 1, 2024. Specifically, the steps are as follows:

Step 1: Submit application

The enterprise completes the reporting dossier and submits it to the competent state management agency (Department of Industry and Trade or Ministry of Industry and Trade) where the promotional activity is registered and has it confirmed within 45 days from the date of award.

Step 2: Decide to collect the value of prizes without winners (if any)

Within 07 working days of receiving the report, if there is a prize value without a winner, the management agency will issue a decision to collect 50% of that prize value into the state budget.

Step 3: Pay and complete the report

Within 45 days from the date of receipt of the decision on collection and payment from the state management agency, the trader is responsible for paying 50% of the announced value of the winning prize of the promotional program according to the decision.

Points to note when reporting promotion results

When reporting promotional program results, businesses should note the following points to ensure accuracy and legal compliance:

Reporting deadline:

  • The report should be submitted no later than 45 days after the end of the award period. If you do not comply with the deadline, your business may be fined according to legal regulations.
  • Reporting on time helps businesses avoid risks and maintain reputation in commercial activities.

Transparent authentication documents:

  • All records and evidence of winning prizes, along with related documents, must be clear, transparent and accurate.
  • Enterprises should store reporting documents for as long as necessary to serve inspection and examination activities from management agencies.

Financial obligations:

  • If there is a prize value with no winner, the enterprise must pay 50% of the value to the state budget. This is a mandatory financial obligation according to the provisions of Decree 81/2018/ND-CP.
  • Correctly fulfilling financial obligations is an important part of helping businesses avoid mistakes during the promotion process.
