Can foreigners participate in social insurance in Vietnam?

Specifically, foreigners must have a work permit or practice certificate issued by a competent Vietnamese agency. They also need to have an indefinite-term labor contract or a fixed-term labor contract of 1 year or more with an employer in Vietnam.

Compulsory social insurance participation applies to both foreign workers working at domestic enterprises and foreign-invested enterprises. This regime ensures the rights of foreign workers when working in Vietnam.

Cases where foreign workers can withdraw social insurance one-time

According to Clause 6, Article 9 of Decree 143/2018/ND-CP, foreign workers working in Vietnam are entitled to one-time social insurance in the following cases:

  • Full pension age as prescribed in Clause 1, Article 9 of Decree No. 143/2018/ND-CP but less than 20 years of social insurance payment;
  • People who are suffering from one of life-threatening diseases such as cancer, polio, cirrhosis, ascites, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS, and other diseases according to regulations of the Ministry of Health;
  • Employees who are eligible to receive pensions according to the provisions of Clause 1, Article 9 of Decree 143/2018/ND-CP but do not continue to reside in Vietnam;
  • When the employee terminates the labor contract or the work permit, practice certificate, or practice license expires without being renewed.

Allowing one-time withdrawal of social insurance creates favorable conditions for foreign workers when they finish their working time in Vietnam. This policy demonstrates Vietnam’s flexibility in foreign labor management.

Profile components

Pursuant to the provisions of Article 109 of the 2014 Law on Social Insurance, the one-time social insurance registration dossier for foreigners includes the following documents:

  1. Social insurance book.
  2. The employee’s application for one-time social insurance benefits follows form 14-HSB.
  3. For people going abroad to settle, they must also submit a copy of the competent authority’s confirmation of renunciation of Vietnamese nationality or an authenticated or notarized Vietnamese translation of one of the following documents:
  • Passport issued by a foreign country;
  • Visa issued by a competent foreign agency confirming permission to enter the country for the reason of residing abroad;
  • Documents certifying that you are applying for foreign citizenship; Confirmation documents or permanent residence card, valid for 5 years or more issued by a competent foreign agency.
  1. Extract medical records for people suffering from one of the life-threatening diseases such as cancer, polio, cirrhosis, ascites, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS and other diseases. According to the regulations of the Ministry of Health and Point c, Clause 1, Article 77 of the Law on Social Insurance 2014.
  2. For employees receiving pensions or monthly social insurance benefits who go abroad to settle and in the case of Clause 5, Article 77 of the 2014 Law on Social Insurance, the application for a one-time benefit is made according to prescribed in Clauses 2 and 3, Article 109 of the Law on Social Insurance 2014.

Execution order

The one-time social insurance registration process for foreigners is carried out according to the following steps:

Step 1: Prepare documents for foreign workers or the authorized person to prepare complete documents according to regulations.

Step 2: Submit your application in the following 2 ways:

  • Directly at the Receiving and Returning Results of Administrative Procedures Department of the Provincial and District Social Insurance Agencies or at the Public Administrative Service Center/Receiving and Returning Results Department of the Office of the People’s Council and District People’s Committee.
  • Through the public postal service. (In case an organization or individual sends a dossier through a postal service provider other than a public postal service provider, the social insurance agency will still receive the dossier and process).
  • Online at the Social Insurance Industry Public Service Portal or through the I-VAN Organization (an organization operating in the field of information technology contracted by Vietnam Social Security to provide value-added services on electronic transactions in the social insurance sector).

Step 3: Resolution time, within 5 working days from the date of receiving complete and valid documents, the Social Insurance agency will resolve and pay the employee.

Note, foreign workers need to submit their application within 10 days from the time of termination of the labor contract or when the work permit or practicing certificate expires.
