• Criminal record or equivalent document of the person expected to be appointed as representative, issued by the competent authority of the host country and consular legalized;
• If this person has resided in Vietnam for more than 6 months, a criminal record must be issued by a Vietnamese agency;
• Foreign language documents must be accompanied by a notarized Vietnamese translation.

Execution order

Clause 3, Article 8 of Decree 126/2018/ND-CP stipulates the procedure for granting a Certificate of registration of establishment and operation of foreign cultural establishments, including three main steps:

• Step 1: The foreign party submits the application to the Ministry of Culture, Sports and Tourism. Applications can be submitted in person or sent by post.
• Step 2: After receiving the application, the authorities will check its completeness. If the dossier is incomplete, within 5 working days, the Ministry will notify the applicant to supplement it.
• Step 3: Within 45 working days from the date of receiving complete and valid documents, the Minister of Culture, Sports and Tourism will issue the License. In case of refusal, the authorities will respond in writing and clearly state the reason.

Duration of Certificate of registration of establishment and operation of foreign cultural establishments

Clause 4, Article 8 of Decree 126/2018/ND-CP specifically regulates the duration of the Certificate of registration of the establishment and operation of foreign cultural establishments. Specifically:

• The certificate is valid for 5 years from the date of issue;
• After expiration, the Certificate can be renewed multiple times, each time not exceeding 5 years.
