Necessary conditions to establish a rice export company

According to the provisions of Article 4 of Decree 107/2018/ND-CP stipulating mandatory conditions for establishing a rice export company. Rice export enterprises must meet facility requirements according to national standards.

Conditions for rice export are prescribed as follows:

  • Have at least 01 specialized warehouses for storing paddy and rice in accordance with national standards and technical regulations on paddy and rice storage issued by competent authorities according to the provisions of the Law on Standards and Technical Regulations;
  • There must be at least 01 rice milling, grinding or processing facility that complies with national technical standards and regulations on warehouses and rice milling, grinding and processing facilities issued by competent authorities in accordance with the provisions of the Law on Standards and Technical Regulations.

Documents need to be prepared when registering to establish a rice export company

According to the provisions of Clause 2, Article 6 of Decree 107/2018/ND-CP, when establishing a rice export company, traders need to prepare an application for a Certificate including the following documents:

  • Application follows Model number 01.
  • Certificate of business registration, enterprise registration or investment certificate, certified copy and stamped as true copy of the original.
  • Contract for leasing warehouse, milling, grinding, and processing facility for paddy or rice or documents proving land use rights, ownership of warehouse, milling, grinding, and processing facility, certified copy and stamped as a true copy of the original.

Process and procedures for business registration of rice export companies

According to the provisions of Article 33 of Decree 01/2021/ND-CP, the business registration process includes the following steps:

Step 1: Choose the type of business
Traders need to choose the appropriate type of business such as: One-member LLC, Partnership, Joint Stock Company, etc.

Step 2: Prepare and submit application

  • Prepare business registration documents according to the selected type and submit them to the Department of Planning and Investment where the business is headquartered.
  • The application needs to have all components, and requirements will depend on each type of business.

Step 3: Appraisal of documents

  • The Business Registration Office will appraise and issue the Business Registration Certificate within 03 working days from receipt of valid documents.
  • If the profile is invalid or the business name does not comply with regulations, there will be a notice of amendment within 03 working days.

Step 4: Receive results and complete fee obligations

  • After the application is approved, the business will receive a Business Registration Certificate and complete its registration fee obligations.
  • Applications can be submitted in the following forms: in person, online or via postal service.

Apply for a rice export business certificate

According to the provisions of Article 6 of Decree No. 107/2018/ND-CP regulating the process of applying for a rice export business license including the following steps:

Step 1: Submit application:

Traders need to submit 01 set of documents to apply for a Certificate of eligibility for rice export business at the Ministry of Industry and Trade. Applications can be submitted in the following forms:

  • Submit directly at the headquarters of the Ministry of Industry and Trade.
  • Send by post to address: Ministry of Industry and Trade, No. 54, Hai Ba Trung, Hoan Kiem District, Hanoi City.
  • Submit via the online public service page, electronic information portal of the Ministry of Industry and Trade.

When submitting applications directly at the headquarters of the Ministry of Industry and Trade, traders can submit photocopies of papers and documents as prescribed in Points b and c, Clause 2, Article 6 of Decree 107/2018/ND-CP and export them. Submit the original copy for comparison.

Step 2: Appraisal of documents

  • Within 15 working days from the date of receipt of complete and valid documents, the Ministry of Industry and Trade shall consider and issue a Certificate according to regulations.
  • In case the Certificate is not issued, within 07 working days from the date of receiving the dossier, the Ministry of Industry and Trade must respond to the trader in writing and clearly state the reason.
