Subjects required to register for environmental protection

• Production, business and service establishments operating before the effective date of the Law on Environmental Protection 2020 generate waste but are not subject to applying for an environmental permit.

Note: Some projects and facilities are exempt from environmental registration, including:

• Investment projects and facilities are classified as state secrets regarding national defense and security.
• Investment projects when put into operation and production, business, and service establishments do not generate waste or only generate waste in small quantities, which are treated by on-site treatment works or are managed. according to local government regulations.
• Other subjects as prescribed by law.

Contents of environmental registration

According to the provisions of Clause 4, Article 49 of the Law on Environmental Protection 2020, the content of environmental compliance includes:

• General information about investment projects and facilities.
• Type of production, business, service; technology, capacity, products; Raw materials, fuel, chemicals used (if any).
• Type and volume of waste generated (solid waste, liquid waste, exhaust gas).
• Plan to collect, manage and treat waste according to regulations (including reuse and recycling of waste).
• Committed to implementing environmental protection according to the provisions of law.

During operation, if an investment project or facility has changes in registered content, the investor or facility is responsible for re-registering the environmental compliance before making those changes.

Environmental registration dossier

Pursuant to Clause 1, Article 22 of Circular 22/2022/TT-BTNMT, the environmental compliance dossier includes:

• Environmental compliance document according to form No. 47, Appendix II of this Circular;
• Copy of the Decision approving the results of appraisal of the environmental impact assessment report of the investment project or facility (if any).

How to register

Owners of investment projects and facilities can submit environmental registration dossiers to the People’s Committee of the commune where the project or facility operates through the following forms:

• Submit directly to the receiving and returning results department of the commune-level People’s Committee.
• Send by mail.
• Submit electronically through the online public service system.

For investment projects and establishments in areas with 02 or more commune-level administrative units, the investor and establishment have the right to choose the commune-level People’s Committee for registration.

Commune-level People’s Committees update data into the information system and national environmental database.
