Subjects subject to sickness regime

According to Article 24 of the Law on Social Insurance 2014, subjects eligible for sickness benefits include employees who are Vietnamese citizens and participate in compulsory social insurance in the following groups:

  • People working under labor contracts: Applicable to labor contracts with a fixed term, indefinite term, seasonal or certain jobs from 03 to less than 12 months; including labor contracts signed between the employer and the legal representative of a person under 15 years old;
  • People working under labor contracts with a term of from 01 full month to less than 03 months;
  • Officials, civil servants and public employees;
  • Defense workers, police workers, and people working in other cipher organizations;
  • Officers and professional soldiers of the People’s Army; officers, professional non-commissioned officers, officers, technical non-commissioned officers of the People’s Public Security; People who do cipher work are paid the same as soldiers;
  • Business managers and cooperative managers receive salaries.

Cases not entitled to sickness benefits

According to Clause 2, Article 3 of Circular 59/2015/TT-BLDTBXH, in some cases employees will not be entitled to sickness benefits as follows:

  • Employees who are sick or have accidents have to leave work due to self-destruction of their health, being drunk or using drugs or drug precursors.
  • The employee takes leave from work for the first time for treatment due to a work accident or occupational disease.
  • Employees suffer from illness or accident that is not a work accident while on annual leave, personal leave, or unpaid leave according to the provisions of labor law; take leave to enjoy maternity benefits according to the provisions of law on social insurance.

Procedures for submitting applications for sickness benefits

Profile components

According to Article 100 of the Law on Social Insurance 2014 and Decision 166/QD-BHXH, documents for sickness benefits include:

In case of inpatient treatment:

  • Copy of hospital discharge certificate of the employee or employee’s child under 7 years old
  • In case the patient dies at a medical examination and treatment facility, it will be replaced by a Death Notice
  • In case the death notice does not show the time of admission to the hospital, there must be additional documents from the medical examination and treatment facility showing the time of admission to the hospital.
  • In case of referral for medical examination and treatment during inpatient treatment, there must be a copy of referral or hospital transfer paper.

In case of outpatient treatment:

  • Certificate of leave to enjoy social insurance (original).
  • In case both parents leave work to take care of their children, the certificate of leave from one of them must be a copy.
  • Or the hospital discharge certificate has instructions from the treating physician or physician for additional leave after the inpatient treatment period.

In case of medical examination and treatment abroad: Vietnamese translation of medical examination and treatment certificate issued from a medical facility abroad.

Execution order

Step 1: Submit application

Within 45 days from the date of return to work, the employee submits the application to the employer.

Step 2: Create profile

Within 10 days from the date of receiving complete documents from the employee, the employer is responsible for preparing documents and submitting them to the social insurance agency.

Step 3: Processing documents

Within 10 days from the date of receiving complete documents from the employer, the social insurance agency must resolve and organize payment to the employee;

In case the social insurance agency does not resolve the issue, it must respond in writing and clearly state the reason.
