Cosmetic announcement records

According to the provisions of Article 4 of Circular 06/2011/TT-BYT, amended by Clause 1, Article 1 of Circular 29/2020/TT-BYT, cosmetic product declaration dossiers include:

  • Cosmetic product proclamation slip (02 copies) accompanied by proclamation data (soft copy of proclamation slip);
  • Power of attorney from the manufacturer or product owner authorizing the organization or individual responsible for bringing the product to market to distribute cosmetic products in Vietnam (original or validly certified copy). For imported products, the Power of Attorney must be consular legalized according to the provisions of law, except in cases of exemption under international treaties to which Vietnam is a member.
  • Certificate of free circulation (CFS) for imported cosmetic products.

Cosmetic announcement process

The cosmetic announcement process is carried out according to the following steps:

Step 1: Submit application:

  • Imported cosmetics: Submitted to the Drug Administration – Ministry of Health.
  • Domestically produced cosmetics: Submitted to the Department of Health where the manufacturing factory is located.
  • Cosmetics sold at industrial and commercial zones in Moc Bai border gate economic zone, Tay Ninh province: Submitted to the Management Board of Moc Bai border gate economic zone.
  • Cosmetics sold in Lao Bao Special Economic and Commercial Zone, Quang Tri Province: Submitted to the Economic Zone Management Board of Quang Tri Province.
  • Cosmetic organizations and individuals declaring cosmetic products with the function of selling cosmetics in Vietnam and located outside the above two zones: Submit to the Drug Administration – Ministry of Health according to the provisions of this Circular.

Step 2: Receive and process documents:

  • The competent state management agency issues the receipt number of the cosmetic product proclamation form within 03 working days if the application is valid and the proclamation fee is paid according to regulations.
  • In case the dossier is not valid, the receiving agency will notify in writing the contents that need to be amended and supplemented within 05 working days.
  • Within 05 working days from the date of receiving additional documents that meet the regulations, the competent state management agency is responsible for issuing the receipt number of the Cosmetic Product Announcement Form.
  • In case the amended or supplemented dossier does not meet the requirements, within 05 working days from the date of receiving the additional dossier, the agency receiving the dossier will notify in writing that it will not issue a cosmetic product announcement receipt number for this product.
  • The deadline for adding documents is 3 months. If this deadline is exceeded, the application will be invalid and must be submitted again.
