When is it necessary to make a cosmetic announcement?

The declaration of cosmetics must comply with strict legal and technical conditions. The cosmetic announcement process requires full compliance with business industry requirements and production conditions. The unit making the announcement must have full legal status according to the provisions of law.

Conditions for carrying out cosmetic announcement include:

• Regarding business lines: Enterprises must register for cosmetic business (wholesale/retail) or import and export of cosmetics;
• Regarding production license: Requires a valid cosmetic manufacturing license for domestically produced products;
• Regarding testing: Products must be tested at licensed centers;
• Regarding import conditions: Requires CFS and authorization from foreign manufacturers;
• Regarding product standards: Products must be on the list of permitted circulation and meet safety standards.

Cosmetic announcement records

Pursuant to the provisions of Article 4 of Circular 06/2011/TT-BYT amended by Clause 1, Article 1 of Circular 29/2020/TT-BYT, cosmetic declaration dossiers must be fully and accurately prepared. Missing documents can lead to extended review time or refusal to accept documents.

Components of the cosmetic announcement dossier include:

1. Cosmetic product announcement form (02 copies) accompanied by announcement data (soft copy).
2. Valid power of attorney from the manufacturer or product owner authorizing the organization or individual responsible for distribution in Vietnam.
3. Certificate of free circulation (CFS) for imported cosmetics:

• CFS exemption: Applicable to cosmetic products from CPTPP or ASEAN member countries if there are documents proving that the product has been licensed for circulation in that country, consular legalized or has confirmation documents from competent authority;
• Valid CFS: For cases not exempted from CFS, the CFS must be valid and consular legalized, unless exempted under an international treaty or principle of reciprocity. CFS must have full information as required by law.

Steps to quickly make cosmetic announcements

The cosmetic announcement process is carried out in strict order, ensuring legality and effectiveness. Each step in the process has its own requirements and processing times.

The cosmetic declaration process is specified in Article 7 of Circular 06/2011/TT-BYT, as follows:

Step 1: Submit cosmetic product declaration dossier

1. Imported cosmetics: Organizations and individuals responsible for bringing products to market submit declaration documents at the Drug Administration – Ministry of Health.
2. Domestically produced cosmetics: Organizations and individuals submit applications to the Department of Health where the manufacturing factory is located (Cosmetics produced from imported semi-finished products are also considered domestically produced products).
3. Cosmetics in border gate economic zones:

• Moc Bai Border Gate Economic Zone (Tay Ninh): Submitted to the Management Board of Moc Bai Border Gate Economic Zone.
• Lao Bao Special Economic – Commercial Zone (Quang Tri): Submitted to the Economic Zone Management Board of Quang Tri province.

4. If products from these zones are brought into the domestic market for business, declaration must be made at the Drug Administration – Ministry of Health.

Step 2: Resolve the publication dossier

1. Processing valid documents:

Within 03 working days from receipt of valid documents and fees, the competent authority will issue a receipt number for the Cosmetic Product Announcement Form.

2. Incomplete or invalid documents:

• If the dossier does not meet the requirements, within 05 working days, the receiving agency will notify you in writing of the contents that need to be supplemented or amended.
• Organizations and individuals making announcements must submit additional documents with a written explanation.

3. Processing additional documents:

• Within 05 working days from receipt of valid additional documents, the competent authority will reissue the cosmetic product announcement receipt number.
• If the additional documents are invalid, the receiving agency will notify you in writing and will not issue a Receipt Receipt number.

4. Expiry date for processing additional documents:

• If within 03 months from the date of receipt of notification, the agency does not receive additional documents, the published documents will no longer be valid.
• Organizations and individuals who want to continue publishing must submit new documents and new fees.
