What conditions are required to trade in tobacco ingredients to be granted a certificate of eligibility to invest in growing tobacco, according to Article 7 of Decree 67/2013/ND-CP (amended by Clause 3, Article 4 of Decree 08/2018/ND-CP) stipulates the following conditions:

  • Registered to trade tobacco ingredients;
  • Regarding conditions on investment scale, facilities, technical equipment and people, there must be an investment scale of local tobacco growing of at least 100 hectares per year;
  • Regarding the conditions for the tobacco raw material business process, there must be a tobacco growing investment contract with the tobacco grower appropriate to the business scale.

Step 2: Within 10 working days from the date of receipt of complete and valid documents, the Department of Industry and Trade reviews and issues a Certificate of eligibility to invest in tobacco cultivation.

  • In case the enterprise does not meet the prescribed conditions, the Department of Industry and Trade will respond in writing to refuse the license and clearly state the reason.
  • In case there are not enough valid documents, within 05 working days from the date of receiving the documents, the Department of Industry and Trade will send a written request to the enterprise to supplement.

The certificate of eligibility to invest in tobacco cultivation is made into 04 copies: 02 copies are kept at the Department of Industry and Trade, 01 copy is sent to the Ministry of Industry and Trade, 01 copy is sent to the issuing enterprise.

The certificate of eligibility to invest in tobacco cultivation is valid for 5 years. 30 days before the license expires, organizations and individuals submit 01 set of application documents to re-issue the Certificate of eligibility to invest in tobacco cultivation in case of continued operation.
