What is a business visa?

Duration of Business Visas for Foreigners

The duration of business visas for foreigners is no more than 1 year

In case foreigners need to extend their stay in Vietnam, they can apply for a visa extension before the current visa expires. Visa extension will be done through the Immigration Department, Ministry of Public Security.

Note that business visa extensions will be considered and decided based on the actual work situation and needs of foreigners in Vietnam. Therefore, customers need to pay attention to monitoring the visa deadline and renew it promptly before the visa expires.

Competent authority to issue business visas for foreigners

According to current legal regulations, the competent authority to issue business visas for foreigners in Vietnam is the Immigration Department, Ministry of Public Security.

Specifically, the Immigration Department is a unit under the Ministry of Public Security, tasked with managing and operating activities related to immigration and residence of foreigners in Vietnam. In particular, the appraisal and issuance of business visas for foreigners entering Vietnam is one of the main tasks of this Department.

Relevant regulations are stipulated in the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014 and guiding documents such as Circular No. 04/2015/TT-BCA, Circular No. 31/2015/TT-BCA of the Ministry of Public Security.

Procedures for applying for a business visa for foreigners

Profile components

1. The foreigner’s original passport is still valid according to regulations;
2. Application form for visa and temporary residence extension;
3. Entry dispatch approved by the Vietnam Immigration Department allowing foreigners to enter and receive visas;
4. Work permit in cases where foreigners are required to apply for a work permit. In case a foreigner is exempt from a work permit, he or she must provide a certificate of work exemption;
5. In addition, depending on the type of business visa application, the following documents must be provided:

• Operating license of enterprises and organizations: Business registration certificate, investment license, operating license of branches, representative offices,…
• Certificate or notice of use of seal of enterprise or organization.
• Introductory document with signature and seal of a competent person at the enterprise or organization sponsoring foreign workers.

Execution order

Step 1: Vietnamese enterprises declare information to the immigration management agency.

Step 2: The enterprise sends an entry application for foreigners to the Immigration Department.

Step 3: The Immigration Department receives and processes the application. If approved, it will send an Immigration Dispatch to the business.

Step 4: The enterprise sends an Entry Document to foreigners so they can apply for a visa at the border gate or diplomatic representative agency.

Implementation time: Within 05 working days from the date of submitting complete and valid documents.

After being approved, the business in Vietnam will send an entry dispatch to the foreigner and check the information so that the foreigner can apply for a visa at the international airport border gate or foreign representative agencies deliver.
