Case 2: Conditions for producing handcrafted wine to sell to establishments with a Liquor Production License for reprocessing

According to the provisions of Article 10 of Decree 105/2017/ND-CP, conditions include:

  • Have a sales contract with an enterprise that has a license to produce industrial alcohol.
  • In case of not selling alcohol to enterprises with an industrial alcohol production license, organizations and individuals producing handmade alcohol must carry out procedures for granting a license to produce handmade alcohol for business purposes according to the provisions of this Decree.

Application for a manual wine production license

The license application needs to be fully prepared according to the provisions of Article 20, Decree 105/2017/ND-CP amended in Article 16, Decree 17/2020/ND-CP. Each type of document must ensure legality. Document processing time is specified.

Profile includes:

  • Application for a License to produce artisanal alcohol for business purposes according to Form No. 01 issued with Decree 17/2020/ND-CP;
  • Copy of Certificate of registration of enterprise, cooperative, cooperative union or business household;
  • Copy of Wine Product Declaration or copy of Receipt of Declaration of Conformity or Certificate of Declaration of Compliance with Food Safety Regulations (for wine without technical regulations); Copy of Certificate of establishment meeting food safety conditions, except for establishments that are small food businesses according to the provisions of the Law on Food Safety;
  • A list of alcohol product names accompanied by a copy of the alcohol label that the organization or individual produces or plans to produce.

Process and procedures for applying for a manual wine production license

According to the provisions of Article 25, Decree 105/2017/ND-CP amended and supplemented by Decree 17/2020/ND-CP specifically stipulates the procedure for applying for a manual wine production license.

Step 1: Submit application

Submit your application to the Economic Department or the Economic and Infrastructure Department of the District People’s Committee through one of the following methods:

  • Direct;
  • By post;
  • Online (if eligibility applies).

Step 2: Processing documents and issuing licenses

  • Within 10 working days from the date of receiving a complete and valid dossier, the competent state agency will review, appraise and issue a license to the trader. In case of refusal, a written response must be made clearly stating the reason.
  • In case of insufficient valid documents, within 03 working days from the date of receipt of the documents, the licensing agency must issue a written request for supplementation.

Licensing fee and license term

According to the regulations in the Fee Schedule attached to Circular 299/2016/TT-BTC, the fee for granting a License to produce craft alcohol for business purposes is: 1.100.000 VND/time/application.

According to the provisions of Point b, Clause 2, Article 28 of Decree 105/2017/ND-CP amended and supplemented by Decree 17/2020/ND-CP, the duration of a license to produce artisanal alcohol for business purposes is 5 years.
