In any case, a product announcement license is required

Pursuant to Article 6 of Decree 15/2018/ND-CP, all organizations and individuals producing and trading food must register product declarations for products belonging to the following groups:

• Health protection foods, medical nutritional foods, and foods for special diets.
• Nutritional products for children under 36 months old.
• Mixed food additives have new uses, food additives are not on the list of permitted uses in food, or are not intended for use according to regulations of the Ministry of Health.

Application for registration of product announcement

Pursuant to Article 7 of Decree 15/2018/ND-CP stipulating that the product declaration registration dossier includes the following documents:

For imported products

1. Product announcement: According to Model number 02 Appendix I issued together with the Decree.
2. Certificate: One of the following types of certificates:

• Certificate of Free Sale (Certificate of Free Sale).
• Certificate of Exportation.
• Health Certificate.
• Issued by the competent authority of the country of origin, consular legalization.

3. Food safety testing result sheet:

• Issued within 12 months from the date of application.
• The testing laboratory must be designated or accredited in accordance with ISO 17025.
• Safety indicators are issued by the Ministry of Health or according to regulations and standards announced by organizations and individuals.

4. Scientific evidence: Prove the use of the product or ingredient that creates the announced use (original or certified copy). The daily dose of the product must be greater than or equal to 15% of the ingredient usage amount in the document.
5. Certificate of production facility: The facility meets the food safety requirements of Good Manufacturing Practices (GMP) or equivalent certification (for health protection foods imported from July 1, 2019).

For domestically produced products

1. Product announcement: According to Model number 02 Appendix I issued together with the Decree.
2. Food safety testing result sheet:

• Issued within 12 months from the date of application submission.
• Tested by an ISO 17025 designated or accredited testing laboratory.
• Safety indicators are issued by the Ministry of Health or according to standards announced by organizations and individuals.

3. Scientific evidence:

• Prove the announced use of the product or ingredient (original or certified copy).
• Daily dose must be greater than or equal to 15% of the ingredient amount in the document.

4. Certificate of establishment meeting food safety conditions: Issued to the production facility if required.
5. Certificate of facility achieving Good Manufacturing Practices (GMP): Applicable from July 1, 2019 for domestically produced health protection foods (certified copy).
6. Document language:

• Documents must be presented in Vietnamese.
• Foreign language documents must be translated into Vietnamese and notarized.

7. Document validity: Documents must be valid at the time of submitting the registration application.

Procedures for registering product announcements

The product declaration registration process is specifically stipulated in Article 8 of Decree 15/2018/ND-CP as follows:

Step 1: Submit Registration Application

Organizations and individuals producing and trading food can submit applications through the following methods:

• Online public service system.
• Post office.
• Submit directly to the application receiving agency.

Identify the receiving agency:

• Ministry of Health: For health protection foods, mixed food additives with new uses, food additives not yet on the list of permitted uses.
• Provincial state management agencies: For medical nutritional foods, foods for special diets, nutritional products for children under 36 months of age.
• Choosing an agency: If the product falls under the jurisdiction of both the Ministry of Health and a provincial agency, organizations and individuals can choose to submit their application to the most appropriate agency.

Step 2: Document Appraisal

The agency receiving the dossier will check the validity and completeness of the dossier and issue a Certificate of Receipt of product declaration registration:

• 07 working days for mixed food additives with new uses, food additives not yet on the list, medical nutritional foods, special diet foods, nutritional products for children under 36 months old.
• 21 working days for health protection foods.

Step 3: Request Document Amendments and Supplements

• If the dossier does not meet the requirements, the receiving agency will request the organization or individual to amend or supplement the dossier.
• Within 07 (seven) working days from receipt of the amended or supplemented dossier, the receiving agency will evaluate the dossier and issue a written response.
• After 90 working days from the date of request for amendment, if the dossier is not amended or supplemented, the dossier is no longer valid.

Step 4: Public Notice

The dossier-receiving agency is responsible for publishing information about the registered product on its website and food safety database.

Step 5: Pay the Appraisal Fee

Production and business organizations and individuals must pay application appraisal fees in accordance with the law on fees and charges to complete product declaration registration procedures.
