Rights and obligations of trade union members

Pursuant to Article 18 and Article 19 of the Law on Trade Union 2012, trade union members have the following rights and responsibilities:

  1. About rights:
  • Trade union members have the right to request the Union to represent and protect their legal rights when they are violated.
  • Union members have the right to be informed, discuss, propose, and vote on the affairs of the Union. In addition, union members also have the right to receive information about the Party’s guidelines, and policies, and laws related to the Trade Union and workers.
  • Union members have the right to run for, nominate, and vote for leadership positions in the Trade Union according to the provisions of the Charter of the Vietnam Trade Union. At the same time, union members also have the right to question union leaders and recommend disciplinary action if there are violations.
  • Union members receive free legal advice and legal aid from the Union on issues related to labor and the Union.
  • The union will also guide and help union members find jobs, learn professions, and visit and support when union members are sick or encounter difficulties.
  • Union members have the right to participate in cultural, sports, and tourism activities organized by the Union.
  • Union members can make proposals to the Union on the implementation of regimes, policies and laws related to employees.
  1. About responsibility:
  • Union members must comply with the Charter of the Vietnam Trade Union and the Union’s resolutions, and actively participate in Trade Union activities to build a strong Trade Union organization.
  • Union members need to improve their political, cultural, professional and professional skills. In addition, union members must also practice the qualities of workers and live according to the Constitution and laws.
  • Union members should unite and help colleagues to improve professional skills and protect the legal rights of workers and trade unions.

Minimum monthly union fee payment from July 1, 2024

Pursuant to Clause 5, Article 23 of the Regulations attached to Decision 1908/QD-TLD in 2016, it is difficult for union members in trade unions and enterprise-based trade unions to determine salaries as a basis for paying union dues; Trade union members who are not subject to paying social insurance: pay union dues at a set level but the lowest level is equal to 1% of the base salary according to State regulations.

Currently, the base salary specified in Decree 73/2024/ND-CP is 2,340,000 VND.

Therefore, the lowest monthly union fee payment is 1% x 2,340,000 = 23,400 VND.

Methods of payment and management of union dues

The method of paying union dues is specified in Article 24 of Decision 1908/QD-TLD 2016 as follows:

  • Trade union dues are paid directly by union members monthly to trade union groups, divisional trade unions, member grassroots unions, grassroots trade unions, and trade unions (according to the hierarchy of the grassroots trade union and trade union).
  • Union dues are collected through monthly salaries (cash or bank transfer) after agreement from union members. In this case, the amount collected from union dues must be confirmed by the unit’s accounting department and have a detailed list of union members paying union dues.
  • Encourage crew members and grassroots unions to innovate collection methods, and crew members to use modern technology (collection via personal accounts, ATM cards, etc) on the basis of convenience, agreement between the corps and the corps base, and be directly issued by the corps in writing.

Accordingly, grassroots trade unions and trade unions assigned to collect union dues paid by union members must open books, record, and fully and promptly reflect the monthly payment of union dues by union members according to the unit’s union member list; preserve and store union dues collection books in accordance with the provisions of the accounting law; and summarize and report on financial revenue and expenditure to the superior trade union. The distribution, use, and management of union dues shall comply with the regulations of the General Confederation of Labor.

Cases of exemption from union dues

Cases of exemption from union dues are prescribed according to Clause 6, Article 23 of Decision 1908/QD-TLD 2016, specifically:

  • Trade union members receive Social Insurance benefits for 1 month or more. During the benefit period, they do not have to pay union dues;
  • Trade union members have no job, no income, and are on personal leave for 1 month or more without salary, during that time they do not have to pay union dues.
