Conditions for issuance of household business registration certificate

According to Clause 1, Article 82 of Decree 01/2021/ND-CP, business households are granted a Business Household Registration Certificate when the following conditions are met:

  • Registered business lines and occupations are not prohibited from business investment;
  • The name of the business household is set in accordance with the provisions of Article 88 of Decree 01/2021/ND-CP;
  • Have valid business registration documents;
  • Pay the full business household registration fee according to regulations.

Where to apply for a household business license?

Pursuant to Decision No. 1323/QD-BKHDT. Applications for a household business registration license can be submitted in two ways:

  • Submit application directly: You can submit it at the Finance – Planning Department – District People’s Committee where the business household is headquartered.
  • Submit online application: You can submit your application via the Public Services page of the People’s Committee of the province/city where the business is located. After the application is received, the system will transfer the data to the Finance – Planning department of the district where the business household is located to process and issue the Business Household Registration Certificate.

Process and procedures for applying for a household business license

Prepare records

Pursuant to Clause 2, Article 87 of Decree 01/2021/ND-CP, the application for a household business license includes the following documents:

  • Application for business household registration;
  • Personal legal documents for business household owners and household members registering business households in case household members register business households;
  • Copy of the meeting minutes of household members on the establishment of a business household in case household members register a business household;
  • Copy of the household member’s authorization document for a member to be the business owner in case household members register their business.

Sequence, procedure

According to Article 87 of Decree 01/2021/ND-CP, the procedure for registering a household business license includes the following steps:

Step 1: Prepare registration documents

  • Business owners need to prepare all required documents and ensure that the documents are valid before submitting.

Step 2: Submit and process documents

  • In case the application is valid: The district business registration agency will issue a Receipt to the applicant. Within 03 working days from the date of receipt of valid documents, the Business Household Registration Certificate will be issued to the business household.
  • In case the profile is invalid: Within 03 working days, the district business registration agency must notify the applicant in writing, clearly explaining the reason for refusal and request to supplement or adjust the application (if necessary).
  • Complaints and denunciations (if any): If within 3 working days from the date of submission of the application, the business household founder does not receive the Certificate of Registration or there is no notice requesting to edit the application, the applicant has the right to complain or denounce according to the provisions of law to protect rights.
