Cases of applying shortened direct contracting

Pursuant to Clause 1, Article 78 Decree 24/2024/ND-CP Clearly stipulate the cases where shortened direct appointment of contractors is applicable, including:

  • The urgent bidding package needs to be deployed to protect national sovereignty and security; The bidding package needs to be implemented to immediately overcome or promptly handle consequences caused by natural disasters, fires, unexpected accidents, incidents, disasters or other force majeure events;
  • Bidding packages for the provision of consulting services, non-consulting services, goods, and construction must be implemented immediately to avoid causing harm to the lives and properties of local residents or to avoid seriously affecting adjacent works;
  • Bidding packages for the provision of consulting and non-consulting services, drugs, chemicals, testing supplies, medical equipment, components, accessories, vehicles, and construction and installation that need to be implemented immediately to serve the work of disease prevention and control or to maintain the operation of medical examination and treatment facilities in urgent cases, to avoid causing harm to people’s lives and health; bidding packages for the purchase of drugs, chemicals, testing supplies, medical equipment, components, and accessories to provide emergency care to patients in emergency situations in cases where medical examination and treatment facilities do not have enough drugs, chemicals, testing supplies, medical equipment, components, and accessories; bidding packages for the purchase of drugs and medical equipment with only one manufacturer on the market.

The contractor appointment process is shortened according to new regulations

Pursuant to Clauses 2 and 3, Article 78 of Decree 24/2024/ND-CP stipulating the shortened contractor appointment process includes the following steps:

Step 1: Prepare and send the draft contract to the contractor

The bidding party prepares a draft contract, clearly defines the requirements on scope, content of work, implementation time, quality, value and sends it to the contractor expected to be able to carry out the bidding package.

Step 2: Complete the contract, submit, approve and publicize the contractor selection results

The bid solicitor and contractor negotiate and finalize the contract. After that, the bidding party submits for approval the contractor selection results and publishes the results on the National Bidding Network System.

The investor posts information about the contractor selection results and sends a written notification of the results to participating contractors within 05 working days from the date of approval decision.

Step 3: Sign a contract with the appointed contractor

The contract signed between the parties must comply with the decision approving the contractor selection results and related documents.

Step 4: Manage contract implementation

The investor is responsible for managing contract implementation, including: monitoring progress, quality, costs and other contract contents. The investor must update the actual progress and publicize the results of contract implementation on the National Bidding Network System.

How long does it take to appoint a contractor?

Clause 5, Article 23 of the Law on Bidding 2023 stipulates the time for appointing contractors as follows:

  • For normal bidding packages: No more than 45 days from the date of approval of the request documents to the date of contract signing.
  • For large-scale, complex bidding packages: No more than 90 days from the date of approval of the request dossier to the date of contract signing.
