• Informed the Ministry of Industry and Trade about setting up an e-commerce sales website.

Will the act of not notifying the sales website be punished?

According to Article 27 of Decree 52/2013/ND-CP amended by Clause 9, Article 1 of Decree 85/2021/ND-CP, traders, organizations and individuals who own e-commerce websites for sales must notify the Ministry of Industry and Trade about the establishment of e-commerce websites for sales if the website has an online ordering function.

In cases where traders, organizations or individuals do e-commerce business but do not carry out procedures to notify sales websites to the Ministry of Industry and Trade, they may be subject to administrative sanctions. Specifically:

Clause 3, Article 62 of Decree 98/2020/ND-CP amended by Point d, Clause 33, Article 3 of Decree 17/2022/ND-CP stipulates administrative penalties for violations of establishing e-commerce websites or e-commerce applications on mobile platforms as follows:

• Fine from 10,000,000 VND to 20,000,000 VND for failure to notify the sales e-commerce website or sales application to the competent state management agency according to regulations before selling goods or providing services to consumers.

Note, the above penalty level is the penalty level applied to individuals, organizations that commit the same violation will be fined twice the amount of the individual’s fine as prescribed in Clause 4, Article 4 of Decree 98/2020/ND-CP amended by Point b, Clause 1, Article 3 of Decree 17/2022/ND-CP.
