The process for obtaining a Retail Outlet License without an ENT is governed by Article 28 of Decree 09/2018/ND-CP. It is a five-step procedure.
Step 1: Dossier Preparation and Submission
The enterprise prepares two complete sets of the application dossier. The dossier can be submitted to the licensing authority (the provincial Department of Industry and Trade – DOIT) via direct submission, postal service, or an online portal if available.
Step 2: Dossier Validity Check
Within 03 working days of receipt, the DOIT reviews the dossier for completeness and validity. If the dossier is incomplete or incorrect, the authority will issue a request for amendment or supplementation.
Step 3: Condition Appraisal and MOIT Consultation
Within 10 working days of receiving a valid dossier, the DOIT appraises the application against the required conditions. If the conditions are met, the DOIT sends the dossier to the Ministry of Industry and Trade (MOIT) for its opinion. If not, the DOIT will issue a written rejection stating the reasons.
Step 4: MOIT Review and Response
Within 07 working days of receiving the dossier from the DOIT, the MOIT reviews the file. It will then issue a written document either approving or rejecting the issuance of the Retail Outlet License. A rejection will include a clear explanation.

Step 5: Issuance of the Retail Outlet License
Within 03 working days of receiving the MOIT’s written approval, the DOIT will officially issue the Retail Outlet License to the enterprise. If the MOIT rejects the application, the DOIT will forward this rejection notice to the enterprise.

The direct issuing authority is the provincial-level Department of Industry and Trade (DOIT) where the outlet is located. However, issuance is contingent upon prior written approval from the Ministry of Industry and Trade (MOIT).
