How much hazardous waste does it take to get an environmental permit?

According to the provisions of Clause 1, Article 39 of the Law on Environmental Protection 2020, group I, group II and group III investment projects that generate wastewater, dust, and exhaust gases discharged into the environment must be treated or waste generated. Hazards must be managed according to regulations on waste management when officially put into operation.

Clause 2, Article 71 of Decree 08/2022/ND-CP stipulates more clearly on this issue: For investment projects and facilities in group I, group II, group III that generate hazardous waste with a total volume of output of 1,200 kg/year or more or 100 kg/month or more during operation, an application for an environmental permit must be prepared.

Thus, not every project that generates hazardous waste must apply for an environmental permit. Only projects in groups I, II, III generate hazardous waste with a volume of 1,200 kg/year or more or 100 kg/month or more.
