For fire safety, Article 13(3) of Decree No. 136/2020/ND-CP issued on November 24, 2020, stipulates the following entities that must apply for a fire safety permit:

  • Construction planning or adjustment projects of urban areas, economic zones, industrial zones, industrial clusters, export-processing zones, high-tech zones, and other functional zones according to the Planning Law;
  • Projects, constructions specified in Appendix V of this Decree when newly built, renovated, or changed in use affecting one of the fire safety requirements specified in point b, clause 5 of this Article;
  • Motor vehicles with special requirements for fire safety when newly manufactured or modified affecting one of the fire safety requirements specified in point c, clause 5 of this Article.

In Appendix 5 to Decree No. 136/2020/ND-CP, projects, constructions, and motor vehicles include:

  1. National agency headquarters with 7 or more stories, or with a total volume of 5,000 m3 or more.
  2. Apartment buildings, collective houses, dormitories with 7 or more stories or with a total volume of 5,000 m3 or more; mixed-use buildings with 7 or more stories or with a total volume of 5,000 m3 or more.
  3. Kindergartens, preschools with 100 or more children or with a total volume of 3,000 m3 or more; primary schools, secondary schools, high schools, schools with multiple grades with a total volume of 5,000 m3 or more; other educational institutions established under the Education Law with 5 or more stories or with a total volume of 5,000 m3 or more.
  4. Hospitals; polyclinics, specialized clinics, nursing homes, rehabilitation centers, orthopedic centers, nursing homes, disease prevention facilities, medical centers, other medical facilities established under the Medical Examination and Treatment Law with 5 or more stories/with a total volume of 3,000 m3 or more.
  5. Theaters, cinemas, circuses with 300 or more seats; conference centers, event organizations with 5 or more stories or with a total volume of 5,000 m3 or more; cultural houses, karaoke service establishments, nightclubs, bars, clubs, beauty salons, massage service businesses, amusement parks, zoos, aquariums with 3 or more stories or with a total volume of 1,500 m3 or more.
  6. Markets, shopping centers, electronics stores, supermarkets, grocery stores, convenience stores, restaurants, eateries with a total volume of 3,000 m3 or more.
  7. Hotels, guesthouses, hostels, other accommodation establishments established under the Tourism Law with 7 or more stories or with a total volume of 5,000 m3 or more.
  8. Offices of enterprises, political and social organizations with 7 or more stories or with a total volume of 5,000 m3 or more.
  9. Museums, libraries, exhibitions, display houses, storage houses, bookstores, exhibition halls with a total volume of 5,000 m3 or more.
  10. Post offices, radio stations, television stations, telecommunications, information equipment installation facilities, data management centers with 5 or more stories or with a total volume of 5,000 m3 or more.
  11. Stadiums with a capacity of 5,000 seats or more; sports arenas, indoor sports centers, fitness centers, racetracks, shooting ranges, other sports facilities established under the Physical Training and Sports Law with a capacity of 5,000 seats or more or with a total volume of 5,000 m3 or more.
  12. Airports; air traffic control towers; seaports; inland water ports; bus waiting rooms, railway stations, cable car waiting rooms for passenger transport, rest stops with a total volume of 1,500 m3 or more; subway systems; vehicle inspection facilities for motor vehicles, businesses, repair, maintenance of cars, motorcycles, motorbikes with a business area of 500m2 or more or with a total volume of 5,000 m3 or more.
  13. Indoor car parks with a total volume of 3,000 m3 or more.
  14. Road tunnels with a length of 500m or more; railway tunnels with a length of 1,000m or more.
  15. Nuclear facilities; production, business, preservation of industrial explosives and explosive precursors; industrial explosive material warehouses, explosive precursor warehouses; import-export ports for industrial explosives, explosive precursors; gas stations, internal fuel supply stations with 01 or more pump columns; gas business establishments, centralized gas supply systems with a total gas capacity of 200kg or more.
  16. Industrial facilities with fire hazard classes A, B with a total volume of 1,500 m3 or more; fire hazard classes C, D, E with a total volume of 5,000 m3 or more.
  17. Power plants; transformer stations with a voltage of 110kV or more.
  18. Production, storage, use of combustible and explosive substances, with a total volume of 1,000 m3 or more. Warehouses for combustible materials, combustible packaging materials with a total volume of 3,000 m3 or more.
  19. Technical infrastructure related to fire safety of urban areas, economic zones, industrial zones, industrial clusters, export-processing zones, high-tech zones, and other functional zones according to the Planning Law under the approval authority of district level or higher.
  20. Motor vehicles with special requirements for fire safety: Rail vehicles, waterway vehicles with a length of 20m or more transporting passengers, transporting flammable liquids, fuels, gases, explosive materials, flammable chemicals, explosives.

  • The transportation system and open spaces must have sufficient size and load capacity to accommodate firefighting vehicles for firefighting activities.
  • There must be firefighting water sources; communication systems, and power supply systems must ensure support for firefighting activities and fire alarm information.
  • The location arrangement for building fire brigade camps for the Fire Department must comply with the regulations of standards and criteria for construction planning.
