Conditions for being granted a postal license

According to the provisions of the Law on Postal 2010, businesses that want to be granted a postal license need to meet the following conditions:

  • Have a business registration certificate for postal activities or an investment certificate in the postal sector. This is a prerequisite for businesses to have legal status operating in the postal industry.
  • Have financial and human resources suitable for the business plan. Enterprises need to demonstrate their financial ability to meet the requirements for investment in infrastructure, equipment and postal operations.
  • Develop a feasible business plan, complying with regulations on postal service prices and quality. The plan needs to demonstrate market feasibility, expected revenue and profit.
  • Take measures to ensure information security, safety for people, postal items and the postal network. Businesses must commit and demonstrate their ability to secure information and ensure safety during the transportation of parcels.

Procedures for applying for a postal license

The application for a postal license must contain the following main documents:

  • Application for postal license according to Sample in Appendix I issued with Decree No. 47/2011/ND-CP dated June 17, 2024
  • Copy of business registration certificate.
  • Charter of organization and operation of the enterprise (if any).
  • Business plan;
  • Sample contract for providing and using postal services in accordance with the provisions of law on postal services;
  • Sample logos, trademarks, specific symbols or elements of the business’s identification system shown on the postal item (if any);
  • Postal service price list is in accordance with the provisions of law on postal services;
  • Announced postal service quality standards apply in accordance with the provisions of law on postal services;
  • Regulations on the limit of liability for compensation in case of damage, the process for resolving customer complaints, and the time limit for resolving complaints in accordance with the provisions of postal law;
  • Agreement with other businesses and foreign partners in Vietnamese, in case of cooperation in providing one, some or all stages of the postal service requested for licensing. These foreign partners must provide documents on legal status that have been consular legalized.
  • Franchise contract with the business providing postal services (if any).

Competent authority

According to the provisions of Clause 1 and Clause 2, Article 9 of Decree 47/2011/ND-CP amended by Point b, Clause 7, Article 1 of Decree 25/2022/ND-CP, effective from June 1, 2022, Authorities competent to issue the postal license include:

  • Ministry of Information and Communications: Issuing and revoking the postal license for cases of providing mail services within inter-provincial and international scope. The Ministry has the highest authority in this field.
  • Department of Information and Communications: Issuing and revoking the postal license for providing mail services within the province. The Department is responsible for managing local postal activities.

Execution order

Procedures for granting the postal license are specifically stipulated in Article 8 of Decree No. 47/2011/ND-CP amended and supplemented by Clause 6, Article 1 of Decree 25/2022/ND-CP effective from the date June 1, 2022 and amended and supplemented documents. The process includes the following main steps:

Step 1: Enterprises and organizations requesting a postal license submit applications via the online public service system to the Ministry of Information and Communications or the Department of Information and Communications corresponding to their authority and responsibility. legality, accuracy and truthfulness of records.

Step 2: Within 03 working days from the date of receipt of the dossier, the competent state agency in charge of postal services shall refuse to issue a postal license in cases that are not within the authority of that agency and state: clear reason. This refusal will be notified in writing via the online public service system.

Step 3: Within 20 days from the date of receiving the application, the competent agency will process the application for a postal license.

  • During this 20-day period, in case the dossier does not meet the regulations, the competent state agency in charge of postal services must notify the business or organization of the contents that need to be amended and supplemented in writing via online public service system.
  • Within 15 working days from the date of notification, businesses and organizations are responsible for amending and supplementing documents as required.

Step 4: Review and return results:

  • In case an enterprise or organization does not amend or supplement documents as required or makes amendments or supplements but does not meet the requirements, the competent state agency in charge of postal services shall notify the refusal to grant a postal license. in writing via the online public service system and clearly stating the reason.
  • The results of postal licensing procedures are paid directly or via public postal services.

Fees, charges and processing deadlines

According to the Fee Schedule for Appraisal of Postal Operation Conditions issued with Circular No. 25/2020/TT-BTC dated April 14, 2020 of the Ministry of Finance, the fee for appraisal and issuance of a postal license is specifically regulated. can be as follows:

  • For licenses issued by the Ministry of Information and Communications: From 21,500,000 VND to 39,500,000 VND depending on the scope of activities.
  • For licenses issued by the Department of Information and Communications: From 10,750,000 VND to 19,750,000 VND depending on the scope of activities.

Enterprises submit application documents for licensing to the competent authority. Applications can be submitted in person or by post. The competent authority receives and checks the validity of the dossier. In case the dossier is incomplete, the agency will guide the business to supplement it. Within 20 working days, the competent authority evaluates the dossier and makes a decision to grant or refuse the license.
