According to the provisions of Clause 1, Article 11 of Decree 15/2018/ND-CP, a certificate of establishment meeting food safety conditions is mandatory for food production and business establishments, except for some cases specified in Clause 1, Article 12 of Decree 15/2018/ND-CP. Specifically includes the following cases:

• Initial production was small;
• Food production and trading without a fixed location;
• Small preliminary processing;
• Small food business;
• Trading in pre-packaged foods;
• Producing and trading in tools and materials for packaging and storing food;
• Restaurants in hotels;
• The collective kitchen does not have a registered food business;
• Street food business;
• The facility has been granted one of the following Certificates: Good Manufacturing Practices (GMP), Hazard Analysis and Critical Control Points (HACCP), ISO 22000 Food Safety Management System, International Food Standards (IFS), Global Standards for Food Safety (BRC), Food Safety System Certification (FSSC 22000) or a valid equivalent.

Costs for obtaining a food hygiene and safety license

The cost of obtaining a food hygiene and safety license includes two main items:

• Fee for appraisal and issuance of certificate;
• Certification fee.

Fee for appraisal and issuance of certificate

Fees for appraisal and issuance of certificates are specified in Circular 67/2021/TT-BTC. Specifically as follows:

1. Appraisal of food business establishments: 1,000,000 VND/time/establishment.
2. Appraisal of food service establishments:

• Serving less than 200 meals: 700,000 VND/time/establishment;
• Serving 200 meals or more: 1,000,000 VND/time/establishment.

3. Appraisal of food production facilities (except health food production facilities):

• For small-scale production establishments that are granted a certificate of establishment meeting food safety conditions: 500,000 VND/time/facility;
• For other production establishments (including both production and business establishments) that are granted a certificate of establishment meeting food safety conditions: 2,500,000 VND/time/facility.

4. Appraisal of health protection food production facilities according to good manufacturing practice (GMP) guidelines: 22,500,000 VND/time/facility.

Certification fee

The fee for issuing a certificate of food safety eligibility is determined as follows:

• Fee for issuance of certificate of food safety eligibility for the first time: 150,000 VND/time.
• Fee for reissuing (extending) certificate of food hygiene and safety eligibility: 150,000 VND/time.
• Fee for issuance of food hygiene and safety training certificate: 30,000 VND/person.

The person who pays the fee for the food hygiene and safety license

According to the provisions of Clause 2 of Circular 67/2021/TT-BTC, organizations and individuals producing and trading food are the ones who pay fees related to food hygiene and safety licenses.
