Subjects are required to participate in unemployment insurance

Pursuant to Article 43 of the Law on Employment 2013, there are specific regulations on subjects required to participate in unemployment insurance, including the following subjects:

Employees must participate in unemployment insurance when working under a labor contract or employment contract as follows:

  • Labor contract or working contract of indefinite term;
  • Labor contract or fixed-term working contract;
  • Seasonal labor contracts or for a certain job have a term of from 3 full months to less than 12 months.

Note: In case an employee signs and is performing multiple labor contracts as prescribed above, the employee and the employer of the first labor contract are responsible for participating in insurance. unemployment.

Note: Employees as prescribed in Clause 1, Article 43 of the Law on Employment 2013 who are receiving pensions or working as domestic workers are not required to participate in unemployment insurance.

Employers participating in unemployment insurance include state agencies, public service units, and people’s armed forces units; political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations; foreign agencies, organizations, and international organizations operating in Vietnamese territory; Enterprises, cooperatives, households, business households, cooperative groups, other organizations and individuals that hire or employ workers under work contracts or labor contracts specified in Clause 1, Article 43 Law on Employment 2013.

Maximum unemployment benefit from July 1, 2024 for employees

The calculation of unemployment benefits is prescribed as follows:

Monthly unemployment benefit = 60% of the average monthly salary paid for unemployment insurance of the 6 consecutive months before unemployment.

Pursuant to Article 50 of the Law on Employment 2013, the maximum level of unemployment benefits from July 1, 2024 for employees is as follows:

  • No more than 05 times the base salary for employees subject to the salary regime prescribed by the State.
  • No more than 0.5 times the regional minimum wage according to the provisions of the 2019 Labor Code for employees paying unemployment insurance according to the salary regime decided by the employer.

And according to the provisions of Article 3 of Decree 73/2024/ND-CP, from July 1, 2024, the base salary for employees subject to the salary regime prescribed by the State is 2,340,000. VND/month.

In addition, based on Article 3 of Decree 74/2024/ND-CP, from July 1, 2024, the regional minimum wage for employees paying unemployment insurance according to the salary regime set by the employer decided as follows:

  • Region 1 is 4,960,000 VND/month.
  • Region 2 is 4,410,000 VND/month.
  • Region 3 is 3,860,000 VND/month.
  • Region 4 is 3,450,000 VND/month.

Accordingly, the maximum unemployment benefit from July 1, 2024 for employees is as follows:

  • Employees subject to the salary regime prescribed by the State are 11,700,000 VND/month.
  • Employees pay unemployment insurance according to the salary regime decided by the employer: 24,800,000 VND/month (Region 1), 22,050,000 VND/month (Region 2), 19,300,000 VND/month month (Region 3), 17,250,000 VND/month (Region 4).

Conditions for receiving unemployment benefits for workers who are paying insurance

Employees who want to receive unemployment benefits need to meet a number of conditions according to the Law on Employment 2013. Pursuant to the provisions of Article 49 of the Law on Employment 2013, employees who are paying unemployment insurance are entitled to unemployment benefits. when the following conditions are met:

  1. Termination of labor contract or work contract. Except for the following cases:
  • The employee unilaterally terminates the labor contract or working contract illegally;
  • Receive monthly pension and disability allowance.
