What is an export airworthiness certificate?

According to Article 4.015 (c) Chapter B of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operations, part 04, the Certificate of airworthiness for export is a document issued by a State agency to the aircraft. of a particular type and model, if the aircraft meets the type design and additional requirements of the importing country.

Conditions for issuance of Export Airworthiness Certificate

Pursuant to Clause 1, Article 10 of Decree 68/2015/ND-CP (amended by Clause 1, Article 2 of Decree 09/2019/ND-CP), Article 4.027(a) Chapter B of the Civil Aviation Safety Regulations Application in the field of aircraft and aircraft operations – Part 4, conditions for issuance of Certificate of airworthiness for export are:

• The aircraft conforms to the type design approved under the Type Certificate or Additional Type Certificate and applicable airworthiness directives issued by the country of design;
• The aircraft has been inspected by personnel authorized by the Civil Aviation Authority of Vietnam in accordance with the implementing rules of this Part and is deemed airworthy within 30 calendar days;
• Aircraft of suitable design and type and technical condition to meet safe operations;

Or if the aircraft has been issued a Certificate of airworthiness by an ICAO member country and registered in the Vietnamese registry, the Vietnam Aviation Administration will recognize that Certificate.

Steps to issue Export Airworthiness Certificate

Prepared documents

Pursuant to Article 20.065, Part 20, Civil Aviation Safety Regulations in the field of aircraft and aircraft operations, documents prepared for the procedure for granting an Export Airworthiness Certificate are

For new aircraft of this type operating for the first time in Vietnam:

• Application for issuance of Certificate of airworthiness for export according to sample in Appendix I Article 20.065, Part 20, Aviation Safety Regulations;
• Copy of the aircraft’s type certificate;
• Copy of aircraft nationality registration certificate; which includes technical specifications and drawings of 03 views of the aircraft.

For new aircraft of a type that has been previously operated in Vietnam

• Application for issuance of Export Airworthiness Certificate according to sample in Appendix I Article 20.065, Part 20, Aviation Safety Regulations;
• Copy of the aircraft’s type certificate;
• Copy of aircraft nationality registration certificate; which includes the Export Airworthiness Certificate for aircraft, engines, propellers and documents indicating the aircraft’s technical specifications.

For used aircraft:

• Application for issuance of Certificate of airworthiness for export according to sample in Appendix I Article 20.065, Part 20, Aviation Safety Regulations;
• Copy of the aircraft’s type certificate
• Copy of aircraft nationality registration certificate; which must contain documents confirming that the aircraft’s records have been checked and that the aircraft is in a safe state for operation according to regulations, and documents related to the entire operation process. Previous exploitation of the aircraft, engines, propellers and equipment installed on the aircraft and documents proving technical specifications

Jurisdiction to resolve

According to the provisions of Article 4.027(a) Chapter B of the Civil Aviation Safety Regulations in the field of aircraft and aircraft operations – Part 4, the competent authority resolves requests for issuance of Certificates of airworthiness. Export is the Vietnam Aviation Administration.

Implementation steps

Step 1: Submit application:

Organizations applying for an export Certificate of Airworthiness must submit 01 set of documents directly or by post to the Civil Aviation Authority of Vietnam.

Step 2: Document handling:

The Civil Aviation Authority of Vietnam checks the validity of the application within 03 working days from the date of receipt of the application; Notify directly or in writing the submitting organization if the application is rejected

In case the application is accepted, within 07 working days from the date of receiving the application, the Civil Aviation Authority of Vietnam will review the application content, agree and officially notify the technical status inspection plan. aircraft technical with the requesting organization

Step 3: Return results

The Vietnam Aviation Administration decides to issue the Certificate of airworthiness for export within 10 days from the date of notification of the plan to check the aircraft’s technical condition.

Aircraft operators are responsible for maintaining and updating aircraft operation and maintenance documents according to regulations; Provide full information to the Vietnam Aviation Administration upon request.

Resolution deadline

The time limit for the Civil Aviation Authority of Vietnam to consider and resolve an application for an export airworthiness certificate is 07 working days from the date of receipt of the application.
