Business Operation Conditions of Valuation Company

To establish a price appraisal company, businesses must meet the requirements as prescribed in Article 49 of the Law on Price 2023. Accordingly,

  • Enterprises must have at least 05 price appraisers qualified to practice at the company.
  • For private enterprises, one-member limited liability companies, partnerships, the business owner or director must have an appraiser card.
  • For LLCs with two or more members, joint stock companies, at least 02 members or shareholders must have appraiser cards. The price appraiser’s capital contribution must account for more than 50% of the charter capital.

Procedures for Establishing a Valuation Company

To establish a price appraisal company, businesses need to be granted a Certificate of eligibility to conduct business in price appraisal services. Accordingly, businesses must prepare documents and carry out the license application process. The required documents include documents such as a list of price appraisers, a copy of the business registration certificate, and documents proving the company’s human resources and financial conditions.

Application for Certificate of Eligibility for Business Price Appraisal Services

Dossier to request a certificate of eligibility to conduct business in price appraisal services is specified in Clause 1, Article 5 of Decree 78/2024/ND-CP, including the following documents:

  • Application for issuance or re-issuance of certificate of eligibility to conduct business in price appraisal services according to Model number 05 specified in the Appendix to the Decree.
  • Copy of business registration certificate; Copy of branch registration certificate if the enterprise has a valuation branch.
  • Practice registration documents of at least 05 people with price appraiser cards registered to practice at the enterprise, according to the provisions of Article 3 of the Decree. If the enterprise has branches, each branch needs to add practice registration documents of at least 03 appraisers.
  • List of capital contributing members and shareholders who are price appraisers, certified by the business. If the business does not have this list information on its business registration certificate, it needs to provide a valid electronic copy of the list.
  • Authenticated copy or valid electronic copy of the document appointing an authorized representative of capital contributing members or shareholders who are organizations, according to the provisions of law on enterprises.

Certification Implementation Process

The process of issuing a certificate to establish a valuation company is specifically stipulated in Article 6 of Decree 78/2024/ND-CP, as follows:

Step 1: Submit application

  • Enterprises requesting a certificate must submit complete documents according to regulations and send them to the Ministry of Finance by one of the following methods: postal service, direct submission or via online public service.
  • Pay the appraisal fee to issue a certificate of eligibility to conduct business in price appraisal services according to regulations

Step 2: Process documents

Within 15 days from the date of receipt of complete dossier, the receiving agency will process the dossier in the following cases:

Incomplete or inaccurate records:

  • The Ministry of Finance provides guidance on supplementing and completing documents via text or online public services.
  • Businesses add and resend within 10 days from the date of instructions.
  • If not fully supplemented, the Ministry of Finance will announce that the certificate will not be issued.

If the application does not meet the conditions: The Ministry of Finance will notify the reason for not issuing the certificate.

If the application meets the conditions: the Ministry of Finance issues a certificate according to regulations.
