  1. Contents of environmental protection reports of investment project owners, production, business and service establishments subject to environmental permits as prescribed in Clause 1 of this Article. Form No. 05.A Appendix VI issued together with Circular 02/2022/TT-BTNMT.
  2. Contents of environmental protection reports of investment project owners, production, business and service establishments subject to environmental registration according to the provisions of Form No. 05.B Appendix VI issued together with Circular 02/2022/TT-BTNMT. Subjects exempted from environmental registration according to the provisions of Article 32 of Decree No. 08/2022/ND-CP are not required to report on environmental protection work;
  3. Contents of environmental protection reports of investors building and operating infrastructure in production, business, and concentrated service zones or industrial clusters according to the provisions of Form No. 06 Appendix VI issued together with Circular 02/2022/TT-BTNMT.

  • The report must be made in 2 copies. 1 in paper document, signed by an authorized person, stamped by the unit and 1 electronic copy (file.doc). Data synthesis forms attached to the report must be stamped.
  • Report in electronic documents according to the format prescribed by a competent state agency or digitized from paper documents, with an electronic signature of a competent person and an electronic stamp of the unit.

  • Owners of investment projects, production, business and service establishments report on environmental protection work annually (reporting period is from January 1 to December 31) before January 15 of the following year;
  • Investors who build and operate infrastructure in concentrated production, business, and service zones or industrial clusters report on environmental protection work annually (reporting period is from January 1 to December 31) before January 20 of the following year.

Method of sending reports and authority to receive reports

The report is sent to the reporting agency by one of the following methods:

  • Send via environmental information systems at all levels or other local information systems;
  • Send and receive directly;
  • Send and receive via postal service;
  • Send and receive via Fax;
  • Send and receive via email system;
  • Other methods as prescribed by law.

Owners of investment projects, production, business and service establishments send environmental protection reports to the following agencies:

  • The agency issues environmental licenses to investment project owners, production, business and service establishments that must have an environmental license.
  • The agency receives environmental registration for investment project owners, production, business and service establishments subject to environmental registration.
  • Department of Natural Resources and Environment (where investment projects and establishments have production, business and service activities).
  • District People’s Committee.
  • Investors who build and operate technical infrastructure in concentrated production, business and service zones or industrial clusters (for establishments located in economic zones, concentrated production, business and service zones or industrial clusters).

Investors who build and operate technical infrastructure in centralized production, business, and service zones send reports on environmental protection to provincial-level specialized environmental protection agencies, environmental licensing agencies, and the Management Board of industrial parks, export processing zones, high-tech zones, and economic zones of provinces and centrally run cities according to the provisions of law.

Investors who build and operate industrial cluster technical infrastructure send environmental protection reports to provincial-level specialized environmental protection agencies, environmental licensing agencies and district-level People’s Committees according to the provisions of law.

Note: Unscheduled environmental protection reports are made at the request of competent state agencies.
