When will the factory be completed?

Currently, there is no concept of completion procedures for factories in legal documents, but from the provisions of Clause 3, Article 97, Clause 3, Article 124 of the Construction Law 2014, Article 26 of Decree 06/2021/ND- CP, the investor completes the factory after completing the construction. It can be understood that construction completion is an administrative procedure that helps confirm with the state management agency that the factory has completed construction according to the construction permit, fully meeting the conditions to be put into use.

According to Decree 06/2021/ND-CP, steps to complete the factory in 2024 include:

Step 1: Prepare and submit documents

Based on Appendix VIB issued with Decree No. 06/2021/ND-CP, factory investors must prepare three groups of documents, including:

  1. Construction investment preparation documents and contracts
  • Decision on construction investment policy and Construction investment pre-feasibility study report (if any).
  • Decision to approve the factory construction investment project and Construction Investment Feasibility Study Report or Construction Investment Technical – Economic Report.
  • Design tasks, appraisal documents, and opinions of relevant agencies in appraising construction investment projects and basic designs.
  • Compensation plan for site clearance and resettlement construction (if any).
  • Documents from competent organizations and state agencies (if any) on: planning agreement, agreement or approval for use or connection to technical workshops outside the fence; environmental impact assessment, safety assurance (traffic safety, safety for neighboring factories) and other relevant documents.
  • Decision on land allocation or land lease from the competent authority or land lease contract in cases where land is not granted.
  • Construction permits, except in cases where construction permits are exempted.
  • Decide to appoint contractors, and approve results of contractor selection and construction contracts between investors and contractors.
  • Documents proving the contractors’ capacity conditions according to regulations.
  • Other relevant records and documents during the construction investment preparation phase.
  1. Construction survey records, factory construction design
  • Survey tasks, survey technical plans, factory construction survey report.
  • Written notice of acceptance of construction survey results.
  • Results of verification and appraisal of construction designs; Decision approving the factory construction design attached: approved factory construction design dossier (with an attached list of drawings); technical instructions.

  • Other documents, materials, and records related to the survey and design phase of factory construction.
  1. Factory construction quality management records
  • List of design changes during the factory construction process and documents of appraisal and approval from competent authorities.
  • As-built drawings (with attached drawing list).
  • Plans and measures to inspect and control the quality of factory construction.
  • Documents certifying the origin of goods, labels of goods, documents declaring standards applicable to products and goods; Certification of conformity, declaration of conformity, notice of receipt of dossiers declaring conformity with specialized agencies; Certificate of conformity (if any) according to the provisions of the Law on Product and Goods Quality.
  • Results of monitoring (if any), measurements and experiments during construction.
  • Minutes of acceptance of construction work, acceptance of parts or factory stages (if any) during the construction process.
  • Results of control experiments, factory quality inspection, and structural load-bearing capacity testing (if any).
  • Quality management records of equipment installed in the factory.
  • Process of operating and exploiting the factory (if any); factory maintenance process.
  • Document of agreement, approval, and confirmation of competent organizations and state agencies (if any) on:

Migrating to the lake bed area, surveying historical and cultural relics;

Fire prevention and fighting safety;

Environmental safety;

Labor safety, safe operation of factory equipment systems and technological equipment;

Implement Construction Permit (in cases where a construction permit is required);

Allows connection to technical infrastructure workshops and other related workshops;

Documents from specialized agencies in charge of construction and urban development management on the completion of relevant technical infrastructure workshops of the project according to the construction plan stated in the approved Feasibility Study Report determine and approve;

  1. Other documents as prescribed by relevant laws.
  • Factory incident resolution records (if any).
  • Appendix of problems that need to be repaired and overcome (if any) after putting the factory and construction workshop items into use.
  • Minutes of acceptance of completed factory and construction workshop items.
  • Written notification from the competent authority specified in Clause 2, Article 24 of this Decree (if any).
  • Relevant records and documents during the acceptance inspection process as prescribed in Article 24 of this Decree (if any).
  • Other related records/texts/documents during the construction phase and acceptance of the construction factory.

Step 2: Submit documents to the competent authority, specifically the specialized agency under the Ministry of specialized construction management as prescribed in Point b, Clause 2, Article 24 of Decree 06/2021/ND-CP, amended by Point a Clause 6 Article 11 Decree 35/2023/ND-CP.

Step 3: The competent authority evaluates the dossier and returns the results.

Pursuant to Clause 5, Point b, Point c and Point d, Clause 6, Article 24 of Decree 06/2021/ND-CP, if the application has complete documents, the application receiving department will collect the application and set a date return results.

The dossier is then appraised, checked and evaluated. If the documents meet the requirements according to the conditions before the project is put into use, the competent authority will sign a decision to complete the factory for the investor and it can be put into operation immediately.
