Conditions for rice export business

According to Article 4, Decree 107/2018/ND-CP, rice export enterprises must meet basic conditions in terms of facilities and business capacity. These regulations aim to ensure the quality of exported rice and the reputation of Vietnam’s rice export industry.

Traders established and registered for business according to the provisions of law may conduct rice export business when meeting the following conditions:

  • Have at least 01 specialized warehouse for storing paddy and rice in accordance with national standards and technical regulations on paddy and rice storage issued by competent authorities according to regulations;
  • There must be at least 01 rice milling, grinding or processing facility that complies with national technical standards and regulations on warehouses and rice milling, grinding and processing facilities issued by competent authorities as prescribed.

Procedures for applying for a rice export license

Documents need to be prepared

According to the provisions of Clause 2, Article 6, Decree No. 107/2018/ND-CP, an application for a rice export license requires the following documents:

  • Application follows Model number 01 prescribed in the Appendix attached to Decree No. 107/2018/ND-CP: 01 original copy;
  • Business registration certificate or Enterprise registration certificate, Investment certificate: 01 copy, certified and stamped as a copy of the original by the trader;
  • Contract for leasing warehouse, milling, grinding, and processing facility for paddy and rice (in case the trader leases warehouse, milling, grinding, and processing facility) or documents proving land use rights, ownership of warehouse, milling, grinding, and processing facility (in case the warehouse, milling, grinding, and processing facility is owned by the trader): 01 copy, certified and stamped as a true copy by the trader.

Licensing authority

The Ministry of Industry and Trade is the state agency with authority to issue rice export licenses.

Procedures for applying for a license

According to the provisions of Clause 3, Article 6, Decree 107/2018/ND-CP, the license application process is carried out through the following steps:

Step 1: Submit application:

Submit 01 set of documents to the Ministry of Industry and Trade through one of the following forms:

  • Submit directly at the headquarters or send by post (receiving address: Ministry of Industry and Trade, No. 54, Hai Ba Trung, Hoan Kiem district, Hanoi city);
  • Or submit your application on the online public service page, electronic information portal of the Ministry of Industry and Trade.

Step 2: Appraise documents and issue certificates

  • Within 15 working days from the date of receipt of complete and valid documents, the Ministry of Industry and Trade will review and issue the Certificate.
  • In case the Certificate is not issued, within 07 working days from the date of receiving the dossier, the Ministry of Industry and Trade must respond to the trader in writing and clearly state the reason.

Special cases do not require a rice export license

Pursuant to the provisions of Clause 3, Article 4, Decree 107/2018/ND-CP, some cases that are exempt from licenses include:

  • Exporting organic rice;
  • Exporting rice fortified with micronutrients;
  • Export of parboiled rice.

License validity period and renewal procedures

According to the provisions of Clause 5, Article 6, Decree 107/2018/ND-CP, the rice export license is valid for 5 years from the date of issue. After this time, businesses must carry out extension procedures to continue maintaining the right to export rice. Renewal procedures need to be carried out at least 30 days before the license expires, to ensure no interruption in the export process.
