Can foreigners work at two companies at the same time?

According to the provisions of Article 19 of the Labor Code 2019, employees have the right to sign many labor contracts with many different employers but must fully ensure the agreed contents.

Is it mandatory to apply for a work permit for the second company?

Pursuant to Clause 9, Article 9 of Decree 152/2020/ND-CP, for foreign workers, working at two companies requires work permits for both parties, as these are considered two independent legal entities, each of which must comply with foreign labor regulations.

Documents and procedures for issuing work permits

Documents need to be prepared

According to Article 9 of Decree 152/2020/ND-CP (amended by Decree 70/2023/ND-CP), the application dossier for a work permit for foreigners includes:

  1. Written request for a work permit from the employer according to Form No. 11//PLI Appendix I issued with this Decree.
  2. In case a foreign worker works for an employer in multiple locations, the work permit application must fully list the work locations.
  3. Health certificate or health examination certificate issued by a competent foreign or Vietnamese medical agency or organization is valid for 12 months, from the date of signing the health conclusion to the date of application submission. Document or certificate of good health according to regulations of the Minister of Health.
  4. A criminal record or document confirming that the foreign employee is not serving a sentence or has not had his/her criminal record expunged or is under criminal prosecution issued by a foreign country or by Vietnam.
  5. This judicial record card or written confirmation shall be issued no more than 06 months from the date of issue to the date of application submission.
  6. Documents proving that you are an expert or technical worker include:
  • Diploma or diploma or certificate;
  • Confirmation document from foreign agencies, organizations, and enterprises on the number of years of experience of experts, technical workers, or work permits that have been granted or confirmation that they are not subject to work permit issuance.
  1. 02 color photos (size 4 cm x 6 cm, white background, straight face, bare head, no colored glasses), taken no more than 6 months before the date of application.
  2. Document approving the need to use foreign workers, except in cases where the need to use foreign workers is not required.
  3. A certified copy of your passport or a copy of your passport with confirmation from your employer that is still valid.
  4. Documents related to foreign workers, except for the case of foreign workers specified in Point a, Clause 1, Article 2 of Decree 152/2020/ND-CP: Documents of foreign enterprises, agencies and organizations sending foreign workers to work in Vietnam and suitable for the expected working position.

Note:

  • Documents in items (2), (3), (4), (6), and (8): must be originals or certified copies.
  • If documents are issued abroad, consular legalization is required, unless consular legalization is exempted under international treaties or reciprocity agreements between countries.
  • All documents must be translated into Vietnamese and notarized/authenticated according to Vietnamese law.

Implementation procedures

According to Article 11 of Decree 152/2020/ND-CP, the process of applying for a work permit will be carried out as follows:

Step 1: Submit application

At least 15 days before the date you plan to start working in Vietnam, foreign workers must submit an application for a work permit to the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, War Invalids and Social Affairs where the worker plans to work.

Step 2: Receive, process documents and issue work permits

Within 05 working days from the date of receiving a complete application for a work permit, the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, War Invalids and Social Affairs where the foreign worker is expected to work will issue a work permit to the person requesting the permit.
