Procedures for extending Work Permits in Vietnam

Application for extension

According to Article 17 of Decree 152/2020/ND-CP and Clause 13, Article 1 of Decree 70/2023/ND-CP, the application for work permit extension includes:

1. Written request for work permit extension of the employer according to Form No. 11/PLI Appendix I issued with Decree 152/2020/ND-CP.
2. 02 color photos (size 4 cm x 6 cm, white background, straight face, bare head, no colored glasses), taken no more than 6 months before the date of application.
3. A valid work permit has been issued.
4. Document approving the need to use foreign workers, except in cases where the need to use foreign workers is not required.
5. Certified copy of passport or copy of passport certified by the employer that is still valid according to the provisions of law.
6. Health certificate or health examination certificate as prescribed in Clause 2, Article 9 of Decree 152/2020/ND-CP.
7. One of the documents specified in Clause 8, Article 9 of Decree 152/2020/ND-CP proves that the foreign worker continues to work for the employer according to the content of the issued work permit.

• Documents mentioned in items 3, 4, 6 and 7 must be 01 original or certified copy. If from a foreign country, it must be consular legalized and must be translated into Vietnamese and notarized or authenticated, unless otherwise stated. exempted from consular legalization according to international treaties to which the Socialist Republic of Vietnam and related foreign countries are members or according to the principle of reciprocity or according to the provisions of law.

Implementation steps

Pursuant to Article 18 of Decree 152/2020/ND-CP. After fully preparing the documents, the employer proceeds with the process of renewing the work permit according to the following steps:

Step 1: Submit application

• At least 05 days but not more than 45 days before the expiration date of the work permit, the employer must submit an application for work permit extension to the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor – War Invalids and Social Affairs has issued that work permit.

Step 2: Receive documents and return results

• Within 05 working days from the date of receiving a complete application for work permit extension, the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, War Invalids and Social Affairs shall extend the work permit. In case the work permit is not renewed, there will be a written response clearly stating the reason.
• For foreign employees working in Vietnam under a labor contract, after the foreign employee’s work permit is extended, the employer and the foreign employee must sign a written labor contract before the expected date of continuing to work for the employer;
• The employer must send the signed labor contract upon request to the competent authority that extended the work permit. Labor contracts must be original or certified copy.
