A license to export and import goods is an important legal document for businesses to legally conduct international trade activities. Applying for this license ensures businesses comply with state regulations, creating favorable conditions for quick customs clearance of goods. At the same time, licenses also help businesses build reputation, minimize legal risks, and optimize business processes in the field of import and export.
According to Clause 1, Article 29 of the Law on Foreign Trade Management 2017, management according to export and import licenses is a control measure of competent state agencies. This measure requires traders to have a license or document of equivalent legal value to carry out import and export activities of goods.
The purpose of license management is to ensure national security, social safety and environmental protection. At the same time, this measure helps strictly control the import, and export of special products, limit trade fraud and protect domestic production.
Management under license applies to items in the list of specialized management. This list is issued and periodically updated by functional ministries and branches. Traders need to clearly understand this list to determine whether or not they need a license before carrying out import and export activities.
The application dossier for an export or import license includes the main documents as prescribed in Clause 1, Article 9 of Decree 69/2018/ND-CP. Preparing complete and accurate documents is an important factor in speeding up the approval process.
Necessary documents in the license application include:
Traders need to pay attention to fully preparing these documents and ensure the accuracy and validity of each type of document. Omissions or errors in applications may result in return or extension of processing time.
The process of granting export and import licenses is carried out according to the following steps:
Step 1: Submit application:
The trader sends 1 set of documents to the ministry or ministerial-level agency with licensing authority. Applications can be made in person, by post or online (where applicable).
Step 2: Check your profile:
The competent authority will check the completeness and validity of the dossier. If the dossier does not meet the requirements, this agency will notify the trader within 3 working days to supplement and complete it.
Step 3: Review and licensing:
Within a maximum of 10 working days from the date of receipt of complete and valid documents, the competent authority will review and issue a licensing decision. In case of refusal, this agency must respond in writing and clearly state the reason.
Processing time may be longer if the opinions of relevant agencies are needed. In this case, the processing time is calculated from the time of receiving the response from the relevant agency.
Legal basis: Clause 2, Article 9, Decree 69/2018/ND-CP.
