According to Decree 08/2022/ND-CP, there are no longer regulations on procedures for registering hazardous waste source owners.

Although the hazardous waste source owner is not required to register, the hazardous waste source owner must still declare the volume and type of hazardous waste in the application for an environmental permit or environmental registration according to regulations.

Thus, currently, hazardous waste generators do not need to register with the waste source owner book. Instead, they must declare hazardous waste in their environmental records.

According to Article 84 of the Law on Environmental Protection 2020, hazardous waste must be treated with appropriate technology and meet legal regulations on environmental protection. Facilities providing hazardous waste treatment services must meet the following requirements:

• In accordance with the National Environmental Protection Planning or planning with content on hazardous waste treatment, except in cases where the facility co-processes hazardous waste.
• Ensure an environmentally safe distance according to regulations.
• Hazardous waste treatment technology must be evaluated and given opinions according to the provisions of law on technology transfer; Encourage the application of environmentally friendly technology, best available techniques, treatment technology combined with energy recovery.
• Have an environmental permit.
• There are personnel in charge of environmental protection who are trained in environmental majors or appropriate professional fields.
• Have procedures for safely operating appropriate specialized technology, vehicles, and equipment.
• Have an environmental management plan including pollution control and waste management; labor safety, labor hygiene; prevent and respond to environmental incidents; annual training and coaching; environmental monitoring program; Evaluate the effectiveness of hazardous waste treatment; Plans for pollution treatment and environmental improvement after completion of operations.
• Environmental protection deposit as prescribed in Article 137 of the Law on Environmental Protection 2020 in case of waste burial activities.
