Conditions for foreigners to own houses in Vietnam

Pursuant to Point c Clause 1, Point c Clause 2 Article 8, Point c Clause 1 Article 17, Clause 3 Article 18 of the Law on Housing 2023, the conditions for foreigners to own houses in Vietnam are:

  • Foreign individuals must be allowed to enter Vietnam
  • Individuals who own houses through purchasing, renting, and purchasing commercial housing from investors in housing construction investment projects, receiving gifts, or inheriting commercial housing in housing construction investment projects are not located in an area that needs to ensure national defense and security as prescribed in Article 16 of this Law;
  • Not eligible for diplomatic or consular privileges and immunities according to the provisions of law.

Cases where foreigners are not allowed to own houses in Vietnam

Pursuant to Clause 1, Article 22 of the Law on Housing 2023, the cases in which foreigners are not allowed to own houses in Vietnam are:

  • Foreign individuals are given or inherit houses that do not fall into the cases specified in Point b, Clause 2, Article 17 of this Law or exceed the number of houses allowed to own as prescribed in Article 19 of this Law, or located in an area that needs to ensure national defense and security as prescribed in Article 16 of this Law;
  • Foreign individuals are not allowed to enter Vietnam but are given or inherited houses in Vietnam.

Administrative procedures for foreigners to own houses in Vietnam

Step 1: Based on point c, clause 2 and point c, Article 3, clause 2, Article 7, Decree 95/2024/ND-CP, foreign individuals need to prepare the following documents;

  • Foreign passport and written commitment not to be eligible for diplomatic or consular privileges and immunities.
  • The above-mentioned passport is still valid with an entry stamp into Vietnam or an equivalent legal document entering Vietnam at the time of signing the housing transaction as prescribed in Point b, Point c, Clause 2, Article 17 of the Law on Housing 2023.

Step 2: Parties conducting housing transactions:

  • Within a maximum period of 03 working days from the date of signing the housing purchase, lease-purchase, or donation contract, the investor, the donor, or the party selling the housing to the foreign individual is responsible for notifying information about the buyer’s name and address of sold, lease-purchased, or donated housing to the provincial housing management agency where the housing is located for posting on the agency’s electronic information portal.
  • Within a maximum of 03 working days from the date of receiving information sent by the seller, lease-purchaser, or donor of the housing, the provincial housing management agency must check and post it on the Electronic Information Portal. from this information.

Step 3: Before issuing a Certificate to a foreign individual, the agency competent to issue the Certificate must check the information posted by the provincial housing management agency.

Within a maximum period of 03 working days from the date of issuance of the Certificate to foreign organizations and individuals, the competent agency issuing the Certificate must notify (by email and in writing) the information on housing has been granted a Certificate to the provincial housing management agency for posting on the agency’s electronic information portal.
