Conditions for constructing road works on currently exploited national highways

According to Clause 2, Article 32 of the Law on Road 2024, effective January 1, 2025, construction works on currently exploited roads must meet strict safety and technical conditions. Organizations and individuals are only allowed to construct when they have a construction permit for works on currently exploited roads from a competent state agency.

However, if you fall into one of the cases in Clause 3, Article 32 of this Law, a construction permit is required on the currently exploited road.

Competent authority to issue licenses

Pursuant to Decision 1531/QD-BGTVT. The competent authority to issue construction permits is: the Vietnam Highway Department, Road Management Area, and Department of Transport assigned to manage national highways, expressways, construction investment and operation roads, exploited in the form of public-private partnership within the scope of assigned management.

Pursuant to Clause 2, Article 14 of Circular 50/2015/TT-BGTVT (amended and supplemented by Circular 13/2020/TT-BGTVT) regulating application documents for road construction permits on national highways currently in use include:

  • Application for construction permit according to the form in Appendix 4 issued with Circular 50/2015/TT-BGTVT;
  • 02 sets of construction design drawings and construction organization measures approved by competent authorities (original copies). The content of construction design drawings shows the scale of the project, essential construction items within the scope of protection of road traffic infrastructure and the contents specified in Points b, c, d, Clause 4 Article 13 Circular 50/2015/TT-BGTVT;
  • Construction organization measures represent construction plans, plans to ensure safety in construction, traffic safety and traffic organization.

Implementation steps

Pursuant to Clause 2, Article 14 of Circular 50/2015/TT-BGTVT (amended and supplemented by Circular 13/2020/TT-BGTVT). The licensing application process is carried out as follows:

Step 1: Submit application

  • The project investor or contractor submits an application for a license to construct road works on currently exploited national highways to the competent authority according to regulations.

Step 2: Receive and check documents

  • In case of direct submission: after checking the dossier components, if they comply with regulations, the competent agency will receive the dossier; If not in accordance with regulations, guide organizations and individuals to complete the dossier.
  • In case of submission via postal system or other appropriate forms: The competent authority receives the application. In case the dossier is not complete as prescribed, no later than 02 working days from the date of receipt of the dossier, there must be written instructions for the organization or individual to complete.

Step 3: Licensing

  • The competent authority will evaluate the dossier and, if eligible, issue a construction permit.
  • In case of refusal to grant a permit, the agency must respond in writing and clearly state the reason.
