  • Have a specific and clear address;
  • Have a certificate of land use rights or a legal business location lease contract;
  • There is a sign clearly stating the name of the fertilizer business.

Second, have complete records and documents to trace the origin of fertilizers according to regulations, including:

  • Invoices and documents for buying and selling fertilizers;
  • Records of import and export of fertilizers;
  • Records declaring fertilizer quality.

Third, people who directly trade fertilizer must meet one of the following two conditions:

  • Receive training and professional development on fertilizers according to the guidance of the Ministry of Agriculture and Rural Development;
  • Have an intermediate degree or higher in one of the majors in horticulture, plant protection, soil agrochemistry, soil science, agronomy, chemistry, biology.

The above conditions are intended to ensure facilities, management processes and professional capacity of the fertilizer business unit. Enterprises need to fully meet these requirements to be eligible for certification.

Process for granting certificates of eligibility for fertilizers trade

Prepare application documents for certification

According to Article 15 of Decree 84/2019/ND-CP, the application file for a Certificate of eligibility for fertilizer trading includes:

  • Application for issuance of Certificate of eligibility for fertilizer trading according to Form No. 08 in Appendix I of Decree 84/2019/ND-CP;
  • Copy of intermediate or higher diploma of a person directly selling fertilizers in one of the majors in cultivation, plant protection, soil agrochemistry, soil science, agronomy, chemistry, biology;
  • Information about certification of training and professional development on fertilizers (shown in the Certificate Application).

Enterprises need to fully and accurately prepare the above documents to avoid having to supplement and complete documents many times. In addition, it is necessary to carefully check the information declared in the application to ensure accuracy.

Submit application and receive documents

The application and reception process is as follows:

  • Organizations and individuals submit applications to the Department of Agriculture and Rural Development where the enterprise is located;
  • Can be submitted in person or by mail;
  • The receiving agency checks the completeness of the dossier:

+ If submitted directly: reply immediately upon receipt;

+ If submitted by post: reply within 2 working days.

  • If the dossier is incomplete, the receiving agency will provide instructions for supplementing and completing it.

Enterprises should proactively contact the receiving agency to clearly understand the requirements and prepare complete documents from the beginning, avoiding wasting additional time.

Appraisal and actual inspection

After receiving complete dossiers, the competent authority will proceed:

  • Appraise the content of the dossier within 10 working days;
  • If the application meets the requirements, conduct a physical inspection at the business establishment;
  • Prepare an inspection record according to Form No. 12 in Appendix I of Decree 84/2019/ND-CP;
  • If the conditions are not met, the enterprise must fix it and notify it for re-inspection.

During this process, businesses need to fully prepare documents, books and facilities to serve the inspection work. If there is a need for remediation, it should be done seriously and promptly notified for re-inspection.

Issue certificates of eligibility for fertilizers trade

Document processing results:

  • If the conditions are met: Issue certificates of eligibility for fertilizers trade according to Form No. 11 in Appendix I of Decree 84/2019/ND-CP;
  • If no response: Respond in writing and clearly state the reason.

The deadline for issuing the certificate is as follows:

  • Within 3 working days from the date of completion of the satisfactory inspection;
  • Total processing time: 13 working days from the date of receipt of complete and valid documents.

The certificate is valid for 5 years. Businesses need to pay attention to the deadline to carry out re-issuance procedures before expiration.
