Details of necessary trademark registration costs

Registering for trademark protection is a legal process to ensure the exclusive ownership and use of a trademark for businesses. This process includes application submission, examination and issuance of trademark registration certificate. Along with that are necessary expenses that businesses need to pay. Include:

State fees

State fees are mandatory fees that must be paid to the Vietnam Intellectual Property Office when carrying out trademark registration procedures. These fees are specifically regulated in Circular 263/2016/TT-BTC of the Ministry of Finance.

  • Application fee: This is the fee that must be paid when applying for trademark protection. The current fee is 150,000 VND/application.
  • Content appraisal fee: This fee is for the National Office of Intellectual Property to appraise the content of the trademark registration application. The fee is 550,000 VND/brand/group of goods and services. Content appraisal fee for the 7th product/service onwards: 120,000 VND/01 product or service.
  • Search fee for trademark content appraisal: The National Office of Intellectual Property collects this fee to look up and compare registered trademarks with protected trademarks. The fee is 180,000 VND/brand/group of goods and services. Lookup fee for the 7th product and service onwards: 30,000 VND/01 product or service.
  • Certification fee: After the trademark is approved for protection, businesses need to pay this fee to be granted a trademark registration certificate. The fee is 120,000 VND/brand.
  • Trademark publication fee: Information about protected trademarks will be published in the Industrial Property Official Gazette. The announced fee is 120,000 VND/brand.
  • Registration fee: This is the final fee to complete the trademark registration procedure. The fee is 120,000 VND/brand.

For example: Business A registers the trademark “ABC” for a group of goods and services. The total state fees that enterprise A must pay is: 150,000 + 550,000 + 180,000 + 120,000 + 120,000 + 120,000 = 1,240,000 VND.

Note:

  • The above fees apply to each group of goods and services. If a business registers protection for multiple groups, the fee will be calculated according to the number of groups.
  • In case the trademark has foreign elements (the applicant is a foreigner, the trademark is protected abroad), the fee will be higher.
  • Customers can look up fee details at the website of the Vietnam Intellectual Property Office.

Service costs

In addition to state fees, businesses can choose to use comprehensive trademark registration services from law firms, consulting companies or intellectual property representatives. Service costs will include tasks such as:

  • Consulting on choosing the right brand.
  • Look up the possibility of registering for protection.
  • Drafting trademark registration documents.
  • Submit documents and track progress at the Intellectual Property Office.
  • Answer questions and handle problems that arise during the registration process.

Advantages of using the service:

  • Save time and effort for businesses.

Customers should choose a service provider that is reputable, experienced and transparent about costs.
