Procedures for registering logo copyright

Registration documents

Pursuant to Article 50 of the Law on Intellectual Property 2005 (amended and supplemented in 2022) and Clause 1, Article 39 of Decree 17/2023/ND-CP, logo copyright registration documents include:

  1. Copyright registration declaration for works of applied art according to sample number 02 Circular 08/2023/TT-BVHTTDL.
  2. Copy of the work (Logo): Provide 02 copies of the logo (including electronic copies) or a fixed copy of the copyright registration logo.
  3. Power of attorney (if any): If the applicant is not the author or copyright owner, a power of attorney from the author or copyright owner must be provided.
  4. Documents proving ownership:
  • If the owner is an individual, a copy of ID card, Citizen ID card or Passport must be provided.
  • If the owner is an organization, it is necessary to provide a copy of the Business Registration Certificate or related legal documents.
  • If the owner of the rights is assigned a creative task, a document confirming the assignment is required.
  • If rights are transferred or inherited, a notarized transfer contract, donation or inheritance documents must be provided.
  1. Written consent of co-authors (if any): If the logo has co-authors, the consent of the co-authors is required.
  2. Written consent of the co-owners (if any): If copyright and related rights are jointly owned, the consent of the co-owners is required.
  3. Written consent to use personal images (if any): If the logo uses another person’s personal image, that person’s written consent is required.

Implementation procedures

Pursuant to Clauses 5 to 8, Article 38 of Decree 17/2023/ND-CP, the steps to register logo copyright will include:

Step 1: Submit application for logo copyright registration.

Authors or copyright owners can directly submit logo copyright registration applications or authorize other organizations or individuals to submit applications on their behalf at one of the following locations:

  • Copyright Department in Hanoi.
  • Representative of the Copyright and Related Rights Registration Office of the Copyright Department in Ho Chi Minh City.
  • Representative of the Copyright and Related Rights Registration Office of the Copyright Department in Da Nang City.

Applications can be submitted directly or by post to the competent authority, or online via the Public Service Portal of the Ministry of Culture, Sports and Tourism.

Step 2: Document processing:

  • Within 15 working days of receiving valid documents, the Copyright Office will issue a Copyright Registration Certificate for the logo.
  • If the application is rejected, the Department will notify the applicant in writing.

According to Circular 211/2016/TT-BTC, brand logos belong to works of applied art, so the brand logo registration fee in 2024 is 400,000 VND.
