Costs related to application fees and application processing

These are fees and charges that must be paid to the National Office of Intellectual Property during the process of filing, examining applications and granting patents. Pursuant to Circular No. 263/2016/TT-BTC, costs related to application submission and processing include:

  1. Application fee: 150,000 VND (per application);
  2. Fee for appraisal of request for priority rights: 600,000 VND (per application/request);
  3. Evaluation fee: 900,000 VND (for each independent protection claim);
  • Formality appraisal fee: 20% x 900,000 VND (each independent protection claim);
  • Content appraisal fee: 80% x 900,000 VND (each independent protection claim);
  • The description has more than 6 pages, from the 7th page onwards, an additional 40,000 VND/page must be paid;
  1. Fee for looking up information to serve the appraisal: 600,000 VND (for each independent protection claim);
  2. International patent classification fee: 100,000 VND/subgroup (in case the applicant fails to classify or classifies incorrectly);
  3. Fee for granting a Certificate of Protection: 120,000 VND (for 1 independent protection request). From the second independent claim onwards, the fee is: 100,000 VND/1 independent claim);
  4. Fee for announcing the Decision to grant a Certificate of Protection: 120,000 VND (from the 2nd picture onwards: 60,000 VND/1 picture);
  5. Information disclosure fee: 120,000 VND (from the 2nd picture onwards: 60,000 VND/1 picture);
  6. Information disclosure fee from the 7th description page onwards: 10,000 VND/page;
  7. Registration fee for Decision to grant Certificate of Protection: 120,000 VND.

Expenses for maintaining the validity and use of protection titles

After a patent is granted, to maintain its validity, an annual maintenance fee must be paid. Maintenance fees are calculated annually and increase over time. This cost includes:

  1. Validity maintenance fee: 100,000 VND
  2. Late maintenance fee (for each month of late payment): 10% of the validity fee
  3. Fees for using protection certificates:
  • First 2 years: 300,000 VND/year.
  • 3rd year, 4th year: 500,000 VND/year.
  • 5th year, 6th year: 800,000 VND/year.
  • 7th year, 8th year: 1,200,000 VND/year.
  • 9th year, 10th year: 1,800,000 VND/year.
  • Year 11 – year 13: 2,500,000 VND/year.
  • Year 14 – year 16: 3,300,000 VND/year.

Methods of payment of fees and charges

  • Submit directly: at the headquarters of the Intellectual Property Office in Hanoi or 2 representative offices of the Department in the city. Ho Chi Minh and Da Nang;

  • Submit online.

Some considerations regarding patent licensing costs in Vietnam

According to Article 7 of Circular 23/2023/TT-BKHCN, the following points should be noted regarding patent registration fees and charges:

  1. Applicants and users of industrial property services must pay fees and charges according to regulations of the Ministry of Finance and other service fees as prescribed.
  2. The collection of fees and charges is carried out as follows:
  • When receiving applications or requests to carry out procedures with regulations on collection of fees and charges, the National Office of Intellectual Property requires the applicant to pay fees and charges according to regulations (make a receipt for the applicant);
  • When collecting fees, the Intellectual Property Office shall make a receipt for the collection of fees as a document for payment of fees, clearly stating the amounts and levels of fees collected, and keep it in the application file to serve the formal assessment of the application;
  • In case of payment of fees and charges via postal service or directly into the account of the National Office of Intellectual Property, the collection of fees and charges is determined through a copy of the fee and fee payment voucher in the application.
