Term of exclusive trademark protection certificate

Clause 1, Clause 6, Article 93 of the Law on Intellectual Property 2005 stipulates the validity of trademark protection certificates as follows:

• The protection certificate is valid throughout the territory of Vietnam.
• The trademark registration certificate is valid from the date of issue until the end of ten years from the date of application, and can be renewed many consecutive times, each time for ten years.

To extend the validity of an industrial design patent or trademark registration certificate, the owner of the protection title must pay fees and charges to extend the validity.

The trademark must not be used by the owner or the person authorized by the owner for a period of five consecutive years before the date of request for termination without a legitimate reason, except in cases where the use is commenced or restarted at least three months prior to the date of request for termination, the validity of the trademark protection certificate will be revoked.

Fee for issuance of exclusive trademark protection certificate

To be granted a trademark protection certificate, you must pay the following fees:

1. Application fee:

• Application fee (including separation application and conversion application): 150,000 VND.
• Fee for requesting an extension of the time limit for responding to the notice of the fee and fee collection organization (each time an extension is allowed): 120,000 VND.

2. Fee for granting Certificate of Protection:

• Fee for granting a Certificate of Protection: 120,000 VND.
• For trademark applications with more than 01 group of products/services, from the second independent point/option/group onwards, an additional payment must be made for each independent point/option/group: 100,000 VND.
• Fee for issuance of Certificate of Registration of Industrial Property Rights Transfer Contract: 120,000 VND.

3. Fees for maintaining, extending, terminating, and invalidating Trademark Protection Certificates:

• Fee for maintaining the validity of the Trademark Protection Certificate (10 years) for each product/service group: 100,000 VND.
• Late maintenance/renewal fee (for each month of late payment): 10% of maintenance/renewal fee.
• Fee for requesting termination/cancellation of Protection Certificate: 50,000 VND.

Fees related to granting trademark protection certificates

The procedure for granting a trademark protection certificate must go through many different stages, each stage incurs a number of different fees. Below are the fees related to granting trademark protection certificates depending on each specific case:

1. Fee for appraisal of industrial property:

• Trademark application appraisal fee; request amendments to narrow the scope of protection; to resolve complaints: 550,000 VND. If the trademark application has more than 6 products/services in a group, an additional payment must be made for each page, each product/service from Saturday onwards: 120,000 VND.
• Fee for classifying goods and services for trademarks (for each group of no more than 6 products/services): 100,000 VND. If each group has more than 6 products/services, an additional payment must be made for each product/service from Saturday onwards: 20,000 VND.
• Fee for appraisal of request for priority rights (per application/request): 600,000 VND.
• Fee for appraisal of request to amend industrial property registration application (for each amended content of each application) – except for amendments according to Protection Titles issued abroad at the request of the fee collection organization: 160,000 VND.
• Fee for appraisal of application transfer request (per application): 160,000 VND.
• Fee for appraisal of application for transfer of industrial property rights (each protection title): 230,000 VND.
• Fees for appraisal of requests for extension, maintenance, and amendment of protection titles; Extension or termination before the validity period of Certificate of contract for transfer of rights to use industrial property objects (each protection title); record changes in industrial property representative information related to industrial property objects in the National Register; Amendment of the Certificate of contract for transfer of rights to use industrial property objects, including: Amendments to the scope of transfer, amendments to extend the term (each protection title related to the amended content) and other amendments (each Certificate of transfer of use rights): 160,000 VND.
• Fee for appraisal of request to terminate validity of protection title (each protection title): 180,000 VND.
• Fee for appraisal of request to invalidate protection title (each protection title): 390,000 VND.
• Fee for appraisal of documents examining industrial property representation profession and industrial property appraisal profession (each subject): 300,000 VND.
• Fee for re-examination of examination results on representative profession and industrial property assessment profession (each subject): 150,000 VND.
• Fee for appraisal of dossier requesting issuance of Certificate of industrial property representative service practice, industrial property appraiser card, certificate of industrial property appraisal organization, dossier requesting deletion of name of industrial property representative, recording/deletion of name of representative service organization, industrial property appraisal organization (including amending information about industrial property representative): 250,000 VND.

2. Fee for handling a request to object to a third party’s application for a Certificate of Protection: 550,000 VND.
3. Fee for looking up information on industrial property:

• Information lookup fees serve the purpose of appraisal, complaint resolution and other tasks within the scope of responsibility; Look up associated trademarks to serve the appraisal of registration documents for industrial property transfer contracts (each protection title): 180,000 VND
• If the object of the search is a trademark with more than 6 products/services in a group, an additional fee must be paid for each product/service from Saturday onwards: 30,000 VND.

4. Fees for publication and registration of industrial property information:

• Fee for publishing information on industrial property: 120,000 VND.
• Fee for registering information on industrial property: 120,000 VND.

5. Fee for using the Certificate of Protection for a trademark for each product/service group for 10 years: 700,000 VND.
6. Fee for appraisal of international registration of industrial property:

• Fee for carrying out procedures for international registration of trademarks of Vietnamese origin – excluding fees payable to the International Office: 2,000,000 VND (this point is amended by Clause 3, Article of Circular 31/2020/TT-BTC).
• Fee for appraisal of modification, transfer, extension, territorial expansion, product list restriction, termination, invalidation of internationally registered trademarks of Vietnamese origin: 1,000,000 VND.

7. Separate fees for international trademark registration under the Madrid Protocol with specific Vietnamese designation are as follows:

• Application appraisal fee for each group of goods or services: 3,600,000 VND.
• Fee for appraisal of renewal application for each group of goods or services: 3,200,000 VND.
