What conditions need to be met to be granted a homestay business license??

Pursuant to Clause 3, Article 48 of the Law on Tourism 2017, a homestay is a form of tourist apartment, so a homestay is also considered a tourist accommodation facility. Thus, to be granted a homestay business license, you need to meet the conditions specified in Clause 1, Article 49 of this Law, including:

  1. Have business registration according to the provisions of law;
  2. Meet the conditions of security, order, safety of fire prevention and fighting, environmental protection, and food safety according to the provisions of law;
  3. Meet the minimum conditions for technical facilities and services to serve tourists as prescribed in Article 28 of Decree 168/2017/ND-CP. Include:
  • There is a reception area, tent and camping area, bathroom, and common restroom;
  • There is a first aid medicine cabinet;
  • There is a security guard on duty when there are guests.

Necessary licenses to operate homestay services

According to the provisions of Points a and b, Clause 1, Article 49 of the Law on Tourism 2017, Clause 1, Article 5 of Decree 96/2016/ND-CP, Article 5 of Decree 136/2020/ND-CP, when providing homestay services, business owners need to prepare the following types of licenses:

  • Business license, including business household/enterprise registration certificate;
  • Certificate of satisfaction of security and order conditions;
  • Certificate of eligibility for fire protection;
  • Document announcing the time to start the homestay business.

Procedures for applying for a homestay business license

Profile components

If the homestay is operated as a household business, based on Clause 2, Article 87 of Decree 01/2021/ND-CP, the documents to be prepared will include:

  • Application for business household registration;
  • Personal legal documents for business household owners or household members registering business households;
  • Copy of the meeting minutes of household members on the establishment of a business household in case household members register a business household;
  • Copy of the household member’s authorization document for a member to be the business owner in case household members register their business.
  • Documents proving eligibility for security and order, fire prevention and other documents proving other conditions to serve the homestay business.

In case the homestay owner chooses a business form to do business, depending on the type of business, the homestay owner will prepare the following documents:

  • Application for business registration.
  • Copies of personal legal documents for private business owners. If it is a partnership, a LLC with two or more members, a joint stock company, or a one-member LLC, then a copy of the legal documents of the company’s members or the legal representative of the business. and members and shareholders.
  • Company charter.

Implementation process

Pursuant to Article 87 of Decree 01/2021/ND-CP, the steps to apply for a homestay business license with a household model are:

Step 1: Submit application for homestay business registration

People who request to register a homestay business submit the application to the Department of Economics – Planning – People’s Committee of the district or city where the accommodation facility is located.

Step 2: Wait for application review

After submitting the application, the business registration agency will review it within 3 working days.

  • If the application is valid, you will receive a homestay business license.
  • If the dossier is invalid, the agency will notify you requesting amendments and additional information. You need to comply with the requirements of the registration agency.

Step 3: Get a homestay business license

After the application is approved and completed, you will receive a license to operate accommodation services. If you have a request to amend or supplement documents, you need to do so within 03 working days of receiving notice from the registration agency.

In addition, according to the provisions of Articles 21, 22, 23, 24 of the Law on Enterprise 2020, when opening an accommodation service under the business model, the registrant needs to take the following steps:

Documents can be submitted online through the National Business Registration Portal or submitted directly to the Department of Planning and Investment of the province/city where you register your business.

Step 2: Review documents and receive results

After submitting the application, the registration agency will review it within 3 working days.

  • If the application is valid, you will receive a homestay business license.
  • If the application has errors or omissions, the registration agency will notify you and request you to amend or supplement the application.

Step 3: Pay the fee and receive an accommodation service business license

After receiving the homestay business license, you need to pay the prescribed fees.

After completion, you will receive the business registration results at the results department of the Department of Planning and Investment.
