Are foreigners required to register for temporary residence?

According to Article 33 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014, amended by Clause 5, Article 2 of the Law on Entry and Exit of Vietnamese Citizens and the Law on Entry and Exit, Transit and residence of foreigners in Vietnam amended in 2023, foreigners coming to Vietnam are required to register for temporary residence through legal accommodation establishments. This regulation is intended to help management agencies promptly update information of foreigners living and working in Vietnam.

For accommodation establishments such as hotels, motels, serviced apartments, and other short-term rental establishments, temporary residence declaration is part of the legal responsibility to assist in residence management.

Accommodation establishments where foreigners stay must make a declaration within 12 hours. For remote areas or border areas, the declaration time is extended to 24 hours.

If they do not comply with this regulation, accommodation facility owners and managers will be administratively sanctioned according to the provisions of Circular 53/2016/TT-BCA.

Thus, temporary residence registration helps foreigners stay legally, ensure their residence rights and comply with Vietnamese law. At the same time, it helps authorities accurately grasp the number of foreigners present in the locality.

Instructions on how to register temporary residence for foreigners

Temporary residence registration can be done through two methods: online registration and registration by temporary residence declaration form. Depending on the actual conditions of the accommodation facility, and geographical area, the declarant can choose the appropriate method.

Register online

Step 1: Register an account on the electronic information system of the Immigration Department, in which the declarant must provide full information about the accommodation facility. To ensure information security, declarants must keep their accounts confidential and not share them with third parties.

Step 2: Declare information of foreigners immediately upon arrival, including personal information and expected length of stay. The system provides a friendly interface to enter data or download sample files according to regulations.

Step 3: Receive information. After completing the declaration, the Immigration Department checks and receives information 24/7. The system will respond to confirm the receipt of the dossier, helping the declarant know the exact status of the declared information.

Online registration helps save time, reduce paperwork and easily manage declared information. Looking up and updating information is also done quickly when there are changes.

Register with temporary residence declaration form

Step 1: Receive a temporary residence declaration form at the commune/ward police station or border guard stations for border areas. Temporary residence declaration form NA17 must be filled out with complete information of the accommodation facility and the foreigner staying, including name, type, address of the facility and information of the foreigner.

Step 2: Transfer the declaration form to the commune police within the prescribed time limit. For urban areas, the time limit is 12 hours from the time the guest arrives; In remote areas, it is 24 hours. The form can be sent in advance by fax or notified by phone to the police station before submitting the original.

Step 3: Receiving the declaration form: The commune-level police check and confirm the information in the declaration form, ensuring that all information is complete. The police will store and update information into the system for accommodation management.

Registration via declaration form is suitable for accommodation facilities without internet connection or located in remote areas where traffic conditions and access to information are limited. Declaration via ballot also ensures the accuracy and validity of the declaration dossier.
